West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I do understand why you would wait for legal opinion. However if it's a negative opinion we will get a large proportion of our funds back. Yes you could argue that you will keep all yours.

I can't see why you need to worry any more if you are on the class action that west brom will call in your mortgage. In fact I think being in does give you the security go having the legal team on your side

How many have you got.? I have paid for my share of 7. I have two other property partners. They initially would only pay for one so I was out voted. Over the last few weeks I managed to persuade them that we should go all in. We all feel much better now. I still maintain that we might be approached by west brom for a settlement .

It is a lot of money I know. And at the moment we could really do without it. But my biggest fear is that having got this far we would end up just having one mortgage put back.

We stand to pay out an extra £11000 plus per annul. My share being £7000 plus more per annum . That takes some earning ! I have no problem when the boe rate goes up. That's what I signed up for. But I never thought in a million years someone would come along and try and steal this off me.

At the end of the day it is your decision I hope you will join up. I think you need to weigh up the cost of being in the class action versus the annual cost for the next 5 - 7 years over and above what you really should be paying.

Have you seen Justin's last post last week where he indicates that in a court case only those paid up members will be represented. This could mean that if we do win you will be able to have your rate overturned but you might have to take legal action yourself.

I hope you will have a good think on this over the next few days and join up this week. I think that very soon you might find that the rate per mortgage increases

I feel much more comfortable now that I have had confirmation that Justin has received the documents and cheque I sent on the 19.11.2013, the post offices tracker system states that it is still in the system. I can sleep tonight knowing that I'm in.

Yes. It's because deep down we know that joining is the right thing to do. People have emailed me already to tell me how much better they feel once they have signed up. It's a real weight of their minds. It should be as easy as selling water to a thirsty man in the desert

3/. How many of your BTL mortgages are with WBBS? Non WB ones are irrelevant to the class action although when we win your other lenders who are hoping we shall lose so they can rip you off also will back off. If though you have more WB mortgages than you can reasonably afford to pay £240 each for. then just come on board with one WB mortgage only. £240 is cheap at the price.

2/. The reality of WB actually calling in a mortgage has been aired extensively in this forum. The sensible consensus is they won't though it cannot be discounted 100%..

1/. Forgive my bluntness in pointing out that the legal opinion which you await is being paid for by the likes of me. In the extremely unlikely event that said opinion says we don't have a chance in court then most of my £240 will be returned to me. Same would apply to you.

So please jump on board now. The price is peanuts versus what you have to lose. Looking forward to having you join us. One immediate benefit is that you will feel confident and glad you did as a result. .

Firstly, i feel a lot better for joining up.... for the first time since September I actually feel empowered... To start with it was quite overwhelming, one lone person against a huge financial institution but what is being achieved here is incredible and I want to be a part of it.

I have done the standard stuff, letters of complaint, written to the financial ombudsman etc with the the same responses that everybody else is getting. However we also wrote to our MP, like everybody else we weren't happy with his reply he failed to grasp the points I was making, I let him know this and he has agreed to a face to face meeting in the New Year, I can't say I am overly optimistic but it's something.

I have completed the Class Action Expression of Interest form and am affected by the rate hike. Unfortunately I am unable to join the Action as my property is in Scotland and the mortgage agreement is governed by Scots Law. There may be others in this situation which means that the percentage take up of the 6,700, the 1,136 and the 540 is higher than you calculate.
A second point is that I have less than a year to run on my WB mortgage and will remortgage before the repayment date so I am not financially disadvantaged as much as those with longer terms left to run. Those in a similar position may be reluctant to join up given that the risk / reward calculation is much less dramatic than for those with longer terms.
The bigger picture of course is that I have other tracker mortgages and am concerned about these lenders trying it on as we learnt last week.
An excellent campaign - I'll be sending a donation to the fund.

I was sceptical of where this was going at first. Potentially 6700 x 240 is a lot of money what if it was not genuine. I followed the comments daily and realised that people were putting in so much effort and I was benefiting from their efforts. I also realised that I was not going to win this on my own

Thanks. Very pleased you have done so. Yes that's what people are telling me. It's a real weight off their shoulders. It's like a problem shared. Yes it's a fair amount of money but at least you have some support. Someone to have a good moan to and when someone or some organisation is extracting the urine it's good to know that whatever the final outcome you gave it a go and did the best you could. Good to be able to look yourself in the mirror in the morning and know you are doing the right thing. God knows how the directors at west brom can even shave ?!

We need more people like you to come forward.
