Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

FAO Mr Philip Lawford, Currently The Account Manager for Intermediaries at The West Bromwich BS

It is interesting to note your "previous role" in being a senior account manager at The West Brom BS from 2002 - 2008. You confirm you were so successful you increased business growth by 600% to £158m in 2008 ! No doubt, you were an account manager to many brokers who introduced up to £1b of BTL Lifetime Tracker Mortgages in The Hawthorn Finance Ltd tranche in 2008.

I note with interest in your resume you have posted on LinkedIn that apart from your excellent Sales Targets, you mention you were responsible for "Coaching, Training and development of sales support staff".

It would be very interesting to note whether you warned/coached any of the support staff that you were in charge of that they were selling "Lifetime Tracker Mortgages" but in reality you were attempting to sell Standard Variable Rate mortgages in disguise as Lifetime Trackers.

As you also detail you have invaluable "problem solving skills", any chance you can help to sort this problem out ?

I will be sending my £240 tomorrow now that I have received my documents from the WBBS. I phoned them today about a document that they omitted to send to me. The girl who answered the call was so rude and officious. I am incensed at their arrogance. We must keep the momentum going.

Of similar interest are the Special Mortgage Conditions, which are (coincidentally) at section 14, albeit of the schedule accompanying the Offer of Loan letter.

THIS section 14 states “The Applicant(s) will at all times remain liable to repay the whole loan… terms required by the Company (i.e. WBMC, rather than WBBS), as detailed in the Offer of loan”.

The intention here is clear. The liability remains throughout the mortgage term for this interest only product. That does not, however, suggest that WB can demand that the liability be CLEARED at any intermediate date without reason.

The cross-reference to the Offer of loan letter is also clear, rather than linking to any other version of the Mortgage Conditions (2006), seen or otherwise.

Simples!

This is such a blatant and unashamed try-on that I am actually embarrassed for WB having to justify this nonsense. That said, if we do end up in court fighting our corner, I can't imagine any of us offering our condolences to the losing side.

I agree that it would seem Solicitors and Mortgage advisors probably cannot be proven to be negligent unless the Court rules in favour of WB. Even here with Solicitors and Mort advisors they are not under a duty of Strict Liability to their clients thus negligence would need to be established.
Thus we would need to establish;-
1. A duty of care, this would seem to exist.
2. Breach of that duty.
3. Damage.
On the question of breach I think we would need to establish that a reasonably competent professional advisor given the facts as they were then known would have drawn the issue to our attention of WB's current position/ potential argument on the matter.
It would seem that the consensus of opinion is that the mortgage paper work does not entitle the WB to act in the way they are proposing thus what were the professional advisors supposed to draw our attention to prior to contracting. Did the professional advisor of anyone who took a WB tracker advise of an adverse potential issue such as we now find ourselves with?

I haven't sent my money or documents in yet.
1. I'm waiting for the legal opinion..
2. I'm concerned WB will call in the mortgage.
3. With multiple BTL mortgages I'm not happy at paying a few thousand pounds.

There are a few more rants about the WBBS (West Bromwich Bullshit) online at the Cherryfind website which is a website for Independent Financial Advisers and Mortgage and insurance advisers. It has a membership that exceeds 20,000. I've submitted my own rant on there and would urge everyone on here to do the same. Just go to the Cherryfind website and click on cherry rant line. Fill in the form and you will be presented with a telephone number. Call the number and leave your rant as a message.

Given that the membership of Cherryfind exceeds 20,000, it is a great way of increasing the exposure for our cause among mortgage advisers and other intermediaries. Hopefully they won't recommend WBBS mortgages to their clients which will hurt WBBS in their pocket.

I came across property118 whilst searching for advice after WBBS lifted their rates.
I have 3 mortgages with them so it is going to hurt. To be perfectly honest I was one of the many lurking in the background watching things develop and waiting to see what happens... but some of your contributors are absolutely correct.. if I want to benefit from this, then I must take responsibility now which is why I have decided to act... As I said documents and cheque now in the post.....
