West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

The Daily Mail also features an article about how Royal Bank of Scotland forced firms that had never missed a payment into liquidation so that it could seize their assets.

I think the Daily Mail needs to be contacted about how the West Bromwich Building Society will be forcing landlords who have never missed a payment into bankruptcy in a similar fashion with this unlawful rate hike. I know the rate hike by WBBS has been featured in "This is Money" but an article about the class action being organised by Property118 via The Law Department would do wonders in reaching out to other affected borrowers as well as those mortgage holders fearful (and fearful they should be) of being next in line in the gunsight reticles of unscrupulous lenders like the WBBS.

The Daily Mail has a huge readership. Whilst the comments section of the Daily Mail often has ignorant numpties bashing landlords, a large number of affected borrowers of the West Bromwich BS are likely to read the Daily Mail. It would certainly help to bring some much needed publicity to this campaign organised by Property118. We may even get some more people contributing to the fighting fund as a result of seeing our cause featured in the Daily Mail.

Just texted about West Brom to Wake up to Money on Five Live as they are talking about the outrage of RBS leaning on businesses. I mentioned Property 118 and our class action. Another programme that may investigate this injustice.

I wonder how the FOS, FCA and PRA would formally react if we were to raise a "Formal Complaint" to each of them on the grounds that they are a) not investigating the matter properly and with pure irony, they are "Not Treating Customers Fairly" by all wanting to find reasons to avoid addressing the issues we are raising ?

Reply from my MP, Sir Alan Haselhurst, this morning enclosing reply to him from Sajid David. Abbreviated it says;

The Govt does nor seek to intervene in pricing and availability of loans which remain commercial decisions. Treasury sets legal framework but does not have investigative or prosecuting powers.

When mortgage regulation was introduced in 2004 distinction was drawn between owner occupiers who face losing their home if things go wrong, and buy to let landlords whose properties are investments and do not face the same risk. The Govt is committed to regulating only where it is plainly necessary to do so to avoid placing additional costs on businesses. As a result BTL landlords do not have the same consumer protection.

Refers me to the Money Advice centre.

I guess now I know, if I didn’t before, what the official attitude is towards the curse of us landlords.

Hello, Just a couple of points to raise. Any comments would be welcome.

I have just received my documents from the WB. I have noticed that they have not enclosed the mortgage offer letter. This is the letter that refers to the terms booklet. They have sent everything else that was requested. I am thinking that they have either lost it or they forgot to enclose it.. I will write back and request the offer letter again. I guess if they have lost it then they cannot argue that I received the booklet with the terms that underpins their reasons for the rate rise. Is this Significant ??

Also, the mortage was arrange through Charcol. The documentation states that Charcols 'recommends this mortage'. The intermediaries section has two two boxes 1) Advice 2) Non Advice. Charcols have ticked box one 'Advice'. I guess I also have a case against Charcols for this poor advice?

Any views?

Its mental and I can quite believe it that the FOS are referring people to the FCA and the FCA et al are referring to the FOS.

What exactly is it that these organisations do or should I say are able to do ?

Alexander, Most of us had a doc or two missing with replies from WBBS and needed to write - again!! - requesting it/them. They will reply eventually with apology and enclose. Just an admin glitch with weight of correspondence. Their photocopiers are likely burning out.

Hang on there! Are the FOS saying they won't investigate our complaints, period? All I have done so far is send the original template letter to FOS saying I shall be submitting a complaint and will be doing so along with everyone else when Justin's template letter is produced. FOS replied to my initial letter saying "we await your complaint" etc.
Apart from complaining to FOS because WBBS have told us to (they enclose the leaflet in their correspondence) we all wish I hope to hit WBBS with the cost of £550 per complaint don't we?
Is it now established that contacting FOS is a waste of time, postage and effort? Someone please correct me if I'm wrong.
It seems the old adage of "if you want a job doing you need to do it yourself" is becoming truer by the day here. Court case here we come.
