West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Adwords and pay per click are different animals. You get paid when someone clicks for the former while you pay likewise for the latter. Llike you say though Mark neither would,likely achieve anything better than we are already getting.

Does anyone feel it would be worth getting in touch with Martin Lewis at MoneySavingExpert to help publicise the immoral and unlawful actions of the West Bromwich Building Society in increasing the tracker margin on our mortgages? Whilst it may be landlords affected in the case of the West Bromwich BS, the conduct of Bank of Ireland, Manchester Building Society, and Skipton Building Society, shows that lenders won't hesitate to do the same thing to residential mortgage holders.

This won't end up just affecting landlords. It will affect every homeowner. The writing is on the wall.

I agree Stuart, I've tried to contact Martin Lewis a few times but so far I've not been able to get him to engage. I agree that he would be a superb guy to get on side as he's incredibly influential. We must try harder in this regard.

People like martin Lewis do not have the bottle to get involved if there is any doubt they maybe on the losing side.

They will be all over this as soon as we look like getting a result. They will swoop in like some kind of super hero !!!

I also think the idea of having a tier of funding using investors whether or not they have a West Bromwich mortgage is a great idea and will tap into a potentially prodigious funding stream. This is as close to a "slam dunk" a case as you can get. Provided this goes to court, any investors paying into the fighting fund will be looking at a potentially lucrative return on their investment.

As I see it the difficulty does not lie with proving our case at court because the preponderance of caselaw and legal rules of construction e.g. the contra proferentem rule, favours us. It lies with securing the necessary funds to finance a group legal action. The West Bromwich (and other lenders) are absolutely counting on the fact that we won't be able to secure the necessary monies to take this matter to court. Justice isn't as much a blindfolded woman holding a sword and a set of scales as she is a high end escort who'll happily spend the night with you provided you can afford her.

I have every faith that we will win at court. The crux of the matter is to secure the funds to take this case to court. This is what will make or break us, not the merits of our argument.
