West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I know someone who maybe interested on these lines. He could easily put his hands on £25000 to £30000 . Any more he would have to find and old pair of trousers and empty those pockets.

He is affected by this and has paid his money. There are absolutely no promises he would go for it. He would have to be 100% certain of capital security. A return would be a bonus but not a absolute requirement. He does not wish to be named but I call him Steptoe .

I would rather not involve him any more than he is . I think put this on the backburner and try and get the funds together ourselves but its something to bear at the back of our minds

5) How can The WBBS claim they are Treating Customers Fairly (PRA/FCA applies to any customer, BTL or 'Consumer') when they are targeting certain segments of their customer base differently, i.e. BTL landlords being targeted with a Rate Hike and Customers with Account Numbers starting with 9 not being targeted.

Personally I would rather us get the funds together ourselves without additional complications but its something that might be available as long as the risk is zero

I would also be prepared to contribute to underwrite this class action (just so I could drive a stake through the heart of this money sucking vampire squid of a building society) if a legal mechanism by which I could do this could be worked out. It's certainly another potential avenue of funding to consider!

The risk is total loss of investment Dean. However, on top of the exteremely encouraging posts on the forum this afternoon I have also have two further telephone calls with people who fancy a punt on this. I'm planning to discuss this with my wife over the next few days too. She's a Chartered Management Accountant so I will value her input, which is only fair really as half the money will be hers if we do decide to have a bit of a flutter on this. I'm not really a gambling man but this really has got me thinking and has clearly stimulated the grey matter for a few others too.

The idea of a 2 tier names appeals to the business man in me. It would make sense to me to invest an extra 50K (its only 50 * what I have already invested and potentially a lot less than the money I've invested in the 6 BTLs. On the basis of, if 2,000 people enter the second phase at £500 = £1,000,000 less the £240 originally invested would give around 900K to distribute to the original names on a pro rata basis (I have 6 so not an inconsequential profit on the previous assumptions, but, more people over 2,000 more money in the bank for me). I'll discuss this with my wife over the weekend.

So perhaps it may be good to ask us original names (as you perhaps have a list of us) if we want to invest the extra monies to make the 100K and close this phase creating a new phase with say £500 entry then democracy rules (perhaps!) This would also appease (somewhat ) my conscience (see below) If we have say 200 now and need 50K it would need £250 more each this is a lot less than I'll lose so I'll cough up (still not a small amount 6*250) but we could close phase 1 now.

But (and it a significant but for me ) I believe in the principle of the fight, not the money (I won't say no if its passed and we win) so I'd prefer the other "n" thousand people affected joined us at £240 first.

So A BIG BIG call to everyone affected who have read this blog PLEASE PLEASE joins us at £240 NOW.

This will also precipitate the court action sooner, we need the £100K and we are nearly there.

If people funded the costs (which I think is a brilliant idea) would it be restricted to those directly involved and those with very deep pockets or could a sort of "crowd funding" situation apply whereby if we needed £100,000 there were 100 shares of £1,000 or 200 shares of £500 and anyone could buy as many shares as they wanted?
That really appeals to me and would appeal, I suspect to many of those already involved.

I assume that the shares would be open for purchase by all supporters of the project rather than just those directly affected by the mortgage interest hike? Mark can you confirm please?
