West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Oh that's strange my post notifications have just suddenly changed (without me doing anything). I used to get the full post by email now i just get the first 2 lines. Has a setting changed on the site? Or do i just need to register on this discussion for the full posts?

When I first wrote the post, I did actually write it under my real name and did the same with my profile. I also included information re: the number of mortgages with West Brom I had that I believed were affected (I think there may be a couple more as a tenant has just texted me today to say there's some more letters from the West Bromwich at my previous address which West Bromwich have sent the letters to. If I do have more mortgages that are affected than I originally thought, rest assured I will pay the extra £240 per additional mortgage for membership of the legal action group). Sadly my paperwork is a mess hence my email to you and Justin re: paying the money first and then sending in the paperwork once received from the West Bromwich via Subject Access Request. Anyway, I'm getting sidetracked. The reason I changed to posting under a pseudonym was that I suddenly wondered if I might get targeted by the West Bromwich e.g. the West Bromwich trying to call in loans immediately in a cynical attempt to intimidate people into not fighting them on the rate increase. As I always like to say, "just because you're paranoid doesn't mean they're not out to get you".

If people on here would feel more comfortable with me posting under my real name I will do so but I get the feeling West Bromwich Building Society and other banks/building societies will resort to all manner of dirty tricks to protect their ill-gotten gains and won't think twice about applying pressure or using intimidation tactics to deter people from taking them to court.

On a different note, regarding the reduction from 2% to 1.9%, does anyone think that West Bromwich are using this as a tactic to maybe reduce the rate hike to a level that would make most members think it's no longer worth pursuing the court case e.g. reducing it to 1% or something similar, and then in the future, a year or two down the line, when the furore has died down, hiking it again and betting there won't be the will or inclination to fight it in the future? To prevent such a scenario, a clear message needs to be sent to West Bromwich and other lenders adopting a "wait and see" approach with WBBS rate hike so they can do the same themselves. This clear and unequivocal message can only be sent by winning at court to stop the current rate hike by WBBS and all future similar rate hikes by other lenders.

I would urge everyone who hasn't yet contributed to the fighting fund to please do so. I know we can win this at court if we have sufficient funds to obtain After The Event insurance. I couldn't fight Skipton Building Society two years ago because I wasn't able to afford the ATE insurance on my own (even though back then you could have claimed ATE insurance costs if you were successful) which scuppered my plans to bring a legal action against Skipton which I believed had a good chance of success. There is strength in numbers people so please once again, join up, contribute, and let's take the fight to West Bromwich Building Society. The West Brom has sent us a message (well, several thousand of them in fact) so now we will send them a message.

And now, for a fleeting moment of levity.....

Hi Helen

We had two types of notification emails which seemed to be causing problems for several people. We are working on the fix at the moment. The emails with the full posts were the ones causing problems, hence the annotated versions are likely to be what you will receive from now on. I understand that some people will prefer those versions but we had to pick the lesser of two problems. Not only was it inconvenient for some people to receive two notifications for every post, the unsubscribe option of the version showing the full post did not work properly and that caused complaints. Given the laws regarding unsubscribing we had to treat that as the most serious issue. I hope you will understand.

Hi Mark,

Not ideal to only get the 2 lines as i often look at on the go (iPhone etc) rather than a pc and I can't see the whole site that way - suppose i will just have to miss reading posts if that's the new system. I just unsubscribed from the 2nd notification to turn that off myself to stop getting double emails.

It's interesting you say that Helen because I also use my iphone a lot and I've only ever received the short versions of the notifications. I just let them build up and then click the oldest notification email, link through to the website and then read the lot in one go. I find turning the iphone to one side and expanding the screen to exclude the right sidebar helps make it a lot more readable too. If there something I need to get back to, e.g. a long post or something which I need to type a long response to I always "mark unread" and leave it to when I get back to my PC. I appreciate it's a change and change is rarely convenient. Sorry about that and hopefully you will get used to the new way of catching up with what's happening here soon 🙂

My thoughts on getting the fence sitters in are well documented.

The 48 hour deadline is a good idea, however, I thought we had hoped that once we have Councels opinion there would be an increase in publicity. If that did happen and new members appeared for the first time through no fault of their own it would be a shame not to allow them to join at the current rate.

A deadline works for me I like the idea of a higher rate for people dragging their heels but perhaps we should reconsider the time at a later date. See what response Councels opinion generates.

I still maintain though that it could come to a point where West Brom step in to speak to our legal team , request the current list of paid up members under a confidentiality agreement and make an offer at that point.

We may not even know about this initially. So I keep stressing the point, GET IN NOW . You will feel a lot better once Justin as your details.

If anyone on the fence wants to email me confidentially with their reasons please do. It will go no further only I will try and persuade you.

2% to 1.9% - I don't think it's enough to persuade many if anyone at all. If that was their intention they would lower it to 1% before reverting back to 2% or more once things calm down... and they know if people don't take it to court first time round it would be a lot more difficult second time round and with it any success in the court...

On a different note, I am totally oppose to increasing the fees for new members, I think right up to start of the court case we should be all inclusive and not discriminate against anyone. We need to encourage more people to join and not create bad feelings out there - so with respect no to that one from me...
