West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

hi 0 if you go back to page 1 and page 2 of the threads, all of the initial media coverage quoted a figure of 6,700 affected BTL borrowers.

How do we know that there is not 10,000 + affected borrowers who meet the criteria that WBBS used but for a number of reasons, WBBS are trying it on with this number to start with.

I doubt many 'Professional BTL customers' who have a Lifetime Tracker with WBBS who have not YET received a letter would be willing to start shouting about that fact.........

I have just registered to participate, but am curious to know why everyone seems to have a letter saying that their mortgage will increase by 1.9%. My letter, which is dated September 2013 but only received in November, says that my increase will be 2%.

Are there any others with this 2% increase?

If you have a spare week you might want to read 144 pages of comments. However there is a summary to do list at the top of each page.

The 1.9% is the new rate WB are ripping us off at now. Your letters seem to have been delayed.

Have a good read through the last couple of weeks stuff. Post any questions you have on here and you will soon be answered.

Just received my 1.9% letters this morning so suspect yours will soon be with you.
What an absolute insult to our intelligence this is and hope this makes it easier to take action against them as this is a blatant admission that they're in the wrong. Their whole terminology is rubbish, 'if market conditions improve and it is prudent to do so, we will reduce this additional charge further'... wtf? i note they only talk about reduce, not increase..

This is an interesting conspiracy theory Stuart. A few weeks ago I had a telephone call from a guy who withheld his number and refused to give me his full name or number. He said he had arranged his BTL tracker mortgage directly with West Brom and had not had a letter from them. His reason for not revealing his identity was that he didn't want to get involved beyond that telephone call as he didn't want to cause trouble for himself. That's perfectly understandable but very frustrating for me. I did post a comment at the time asking anybody who had arranged their BTL tracker mortgage directly with West Brom to come forward. I didn't get a response!

This is an interesting strategy Jeremy and one which I have come across before. If you pay £1 for one month and then resume the correct payments monthly thereafter you are technically less than one month in arrears and the lender can't report mortgage arrears to the credit referencing agencies. That's the theory, I couldn't recommend it though as I have never spoken to somebody who has done this in practice. You'd have to be either very brave or very desperate to try this tactic if you could otherwise afford to make the full payment.
