West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

That's if would-be landlords DON'T find the thought of no-win-no-fee rather odd, if they are required to nevertheless cough up £240/mortgage to access this? It seems contradictory, or worse.......or am I missing something here? A good idea in principle, however.

However having now got the best part of £50000 . A thought for later should we not be able to raise more than £100 000. Would a barrister consider a £40 000 retainer plus say £1000 per mortgage if successful.? Currently I think there are nearly 200 mortgages. If we came to a point where funds were not sufficient I'm sure people would be only too happy to deposit it guarantee £1000 per mortgage. Again if people thought it was the only option maybe more would sign up. I know you don't just want a result for those registered but if it's the only option on the table ? A barrister would be guaranteed say £40000. Possibly rising to an additional £200 000 plus ?

Maybe not something for now but a thought for the backburner. Possibly only open to those registered with justin at a certain date.

If that's a possibility we might get a few extra who are sitting and waiting pitting their names in the hat ?

The fees for our own legal team are only half the problem Dean, the biggest issue is the cost of legal fees insurance to cover the other sides costs if we lose. The fee for that is circa £100,000 payable only if we win, however, the premium cannot be claimed from the other side whereas our legal Counsels fees can. Therefore, win or lose we still need £100k minimum.

@Incensed landlord - agreed, pay £240 per mortgage for a referral to a 'no win no fee' solicitor to sue your other solicitor is in need of a decent spin Doctor to turn it into a compelling sales pitch LOL

@Helen Landlord - if your broker went bust I'm not really sure what happens if they didn't buy run off insurance. The Law Society seem to have this covered when a solicitor goes under as they have the Solicitors compensation fund. I don't know about IFA's though as the brokerage I ran only ever did non-advised unregulated sales.

I'm really sorry Helen but I wouldn't know where to start if the were regulated by the FSA directly. However, if they were a member of a network that's your starting point, assuming they still exist. Does your KFI confirm the sale was advised?

Tomorrow I plan to write a post here to explain why non-advised was so popular during the boom and why the tables turned towards advice since the credit crunch.

Yes advised. The network were Premier Mortgage Service so I will see if they still exist.
