West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Mark - if the FCA are not interested, and the ASA are attempting not to be interested, The British Building Society Association have clearly told me they aren't interested, please can you remind me whether we have made a direct approach to the PRA given the lack of willingness of other regulatory entities ?

The PRA works alongside the Financial Conduct Authority (FCA) creating a “twin peaks” regulatory structure in the UK. The FCA is a separate institution and not part of the Bank of England. The FCA is responsible for promoting effective competition, ensuring that relevant markets function well, and for the conduct regulation of all financial services firms. This includes acting to prevent market abuse and ensuring that consumers get a fair deal from financial firms. The FCA operates the prudential regulation of those financial services firms not supervised by the PRA, such as asset managers and independent financial advisers.

No one actually wants to take responsibility for anything nowadays.

All these organisations are set up but they are effectively toothless tigers.

Our only hope is Court . So if you are reading this and have not sent in your documents and cheque do so as soon as possible please

"Dear Mr Alexander

Thank you for your response. I do appreciate your concern, and understand your point that the FCA does not regulate buy-to-let mortgages. However, looking at the original ad which you submitted with your complaint, it was advertising tracker mortgages in general rather than specifically buy-to-let. Furthermore, we have just confirmed with the FCA that given this, we are able to refer complaints of this nature to them.

I hope this information is useful and you are able to pursue your complaint.

Dear Emma

I saw the correspondence between Martin Wheatley from the FCA to Andrew Tyrie MP – Head of the Treasury Select Committee regarding the Bank of Ireland’s tracker rate hike. The FCA were about as effective as a chocolate fireguard! They didn’t even seek independent advice from a QC.

The FCA assured Andrew Tyrie the case was isolated but now the West Brom have followed suit and other mortgage lender will doubtless follow them.

I have provided you with clear evidence that West Brom produced misleading advertisements and you have chosen to ignore that. I am incredibly disappointed.

You should also not that I am blogging our correspondence via Property118.com which has circa 200,000 followers. So far the thread on this subject has over 42,000 readers and nearly 1,400 comments posted.

I've been leaving the FCA, the FOS and the PRA to our legal Cousel to deal with. Let's see what Emma from the ASA comes back with. I might suggest to her that she involves the PRA.

Dear Emma

Further to my last email why do you feel the FCA are better placed to deal with this misleading advertisement than the ASA?

It seems to me that ASA is simply passing on the ‘hot potato’ only for the FCA to waste our time and then respond by confirming this is not their remit due to buy to let mortgages not falling under their regulatory remit.

If I were to make ridiculous claims in advertisements targeting Doctors would you refer complaints to the General Medical Council? However ridiculous that might sound, it’s how I feel my complaint has been treated by the ASA.

The buy to let mortgages I am referring to were all “Tracker Mortgages” with the West Brom.

It really is pathetic how at this site there has been such ample demonstrations that civil servants all too often find it impossible to read a letter properly and answer the points raised sensibly.
The shame is it would be pointless asking to refer the matter to the person's superior, as they are more than likely to be as clueless as the original respondee was.

Tell me about it David, the ASA clearly don't know the difference between a tracker mortgage and a savings bond judging by Emma's first response. Having corrected her mistake following my less that subtle observations she then goes on to assume that a buy to let mortgage is something different to a tracker mortgage. Two simple mistakes made, both in her eagerness to pass on the hot potato. I really do despair at times!

Mark, once again, please do not feel the need to reply if already covered, but I cannot remember if we have contacted The Office of Fair Trading already or not ?

The West Brom seem to have carried out the "perfect financial miss selling crime" and no-one is interested in bringing them in order.
