West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

"I've found and fixed the problem. Pagination was not being applied if you were looking at the page in a browser that has never left a comment before. I went over the comment pagination code and make a few tweaks and now it seems to be working as it should."

Yep, great article. The WB response is interesting -
“We believe the details and the reasons behind possible changes in rates of interest are stated clearly. It is no different to any other T&C of the mortgage. Everything has equal prominence.”

So it's only their belief! in the same way as Father Christmas!
Everything thing has equal prominence? Depends on a blind spot that hides everything else that mentions "for the Lifetime"
And still no mention of the condition that says details on the offer letter take precedent .

They information that WBBS has on myself indicates that it relates to post-May 2013 information... UNLESS it has relied on a speculative telephone call I made to it in January 2013 suggesting I might be considering increasing our property portfolio and whether it had any suitable products.

I did have an Experian account until about 6 weeks ago and nothing was showing on it then, so I'd assumed that WB had searched its files only very recently.

Very interesting!

Hi everyone, and especially Dean (further down),
I've not put in much regarding the website, as there is a lot going on and people have pretty much covered the things I was concerned about; but just to assure you that I am reading each and every comment. However, I have been actively promoting our cause!
I also sent a longish e-mail to MoneyBox, just to put a little more pressure where I believe it's needed. Who knows, maybe, just maybe they'll realise the significance of this when/if it becomes clear that it'll hit people in general.
Dean: As you say MoneyBox aren't overly interested in we landlords - and nor the media and public in general as they're invariably criticising us for one thing or another. It's something I really feel strongly about, for I've never head anything positive said about landlords; it's always been a victim mentality on the behalf of the tenants, as if we're greedy, unfeeling or just generally uncaring and avaricious. I'm sick to the teeth of this, to be honest, as we're always stuck in the middle, between the lender and the tenant: The lender can do pretty much as they please it seems, without much recourse for the likes of landlords being able to redress any unfair treatment. However, the tenants too have a lot of sway and influence over landlords.
So those two entities have much power, and in law, to protect them, but we landlords, who are the ones providing the PROFITS for the lenders, and ACCOMMODATION for tenants, are the ones taking all the risk AND with the least control and power. Far from tenants being 'vulnerable, WE are, but somehow we are the ignored party in all this, when without us there would be an even greater property shortfall!
So yes, MoneyBox, and other programmes like You & Yours, indeed like to jump on the bandwagon of mainstream debate - even though, ironically, the MEDIA is the primary cause of much of this anti-landlord stance with the public. They have been bashing us for far too long now. Am I the only one to feel 'victimised' here?
Also, I totally agree with your cynical view, Dean, that when we do start making inroads and positive change for we landlords with this Class Action, that they will certainly THEN scramble for the headlines. Suddenly we mean something, but not because they care about us, but merely listener figures!
I just hope they don't cry wolf IF we were to lose and tenant's rent has to increase because of this West Brom move. They can't say we didn't warn them!

Sounds promising.
They do, I think, all get the monthly updated AdvisorNet CD, if we can get on that, we might have cracked it.

I've just emailed the editor of Advisor magazine with the press release, just as a different tack.
