West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Hi all,
Phew that took a bit of reading to get here!!!! :):)
Just a quick note to say hello and thanks for all the good work you have all done so far! I've sent my documents and payment of to Justin on the 5th (not heard anything yet or had my cheque cleared but I'm sure he's busy). Emailed moneybox, sent a letter to my MP etc etc.
Mark not sure if you are aware but if you try to read this thread without being logged in as a member it all comes up on one page. This is enormous and caused my computer to freeze numerous times. Not sure if new interested people may find it difficult to read and give up before becoming members. Maybe just my computer set up but thought it was worth a mention.

Really all that. We asked for our subject access info separately. So we should get that each. The more the better as far as I'm concerned I'm pleased a chased it up again today.

Dean's response to your strange post is spot on. Do you really believe Colin that it is seemingly normal for employees of WB to crack under pressure and stress due to fielding complaints from the likes of us? Nice work if you can get it though getting long term off sick paid leave.
Armed Forces don't crack under stress thank heavens. Good job WB staff didn't have to serve as aircrew in Bomber Command during WW2. They would not have lasted one op let alone a tour the poor darlings.
On a jauntier note my MP, Nadhim Zahawi - Stratford -on-Avon, has come on board.
I am attending the Landlord & Letting Show at Stoneleigh near Coventry on 27 Nov to hand out flyers and put "pressure" on landlords to join us. I hope they won't get stressed!
I can't attend 28 Nov. If anyone else can be there that day let me know and I'll brief you evening before how it went for me.

Welcome to Property118 and thank you for your support.

I have been unable to replicate the issues you have experienced with all comments appearing in a single page. I have tested in Google chrome, Firefox and Internet Explorer browsers both logged in and logged out.

Are you using an up-to-date browser and if so, which one please?

Also, if you log out now does the thread still show on one page or does it revert to being on a single page again?

I am going to run another set of tests from a PC and a Mac which has never been used to connect to Property118. The difficulty I will have will be to find one! My friends and family are all members 🙂

Just for the record Mark I too suffered from this problem until I registered and logged on. Found it very frustrating and in some cases it crashed my browser.

Just accessed the site again without login and it was unuseable. Loged in and it was fine.

I am using IE version 8

On the response times etc from the WBBS we sent our Subject Acess Request to them by letter on the 16th October and got a response yesterday saying that they couldn't continue with the request as my wife hadn't signed the letter. ( schoolboy error on my part)

However, as opposed to doing what they did with you Alexander and marking through the info relating to my wife and then sending it, they have returned our cheque asking us to either resend the letter and both sign or confirm that I want just my info back.

Letter and original cheque back in the post this morning with both signatures on !

Ps - Mark my computer does the same freezing thing if Im not logged in

What you would be best doing is sending in two different envelopes two individual requests for this information with two separate cheques about a week or so apart

That's what my wife , her property partner and I did . So we are expecting 3 subject access reports back

Are we still expecting word from Justin today ?

I thought he mentioned last week he would be speaking to the Barrister Tuesday and updating us , probably Wednesday ( today) . Getting some draft FOS letter together . Then he would be getting written opinion in a week or so .

Is that still the plan ?
