Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Anyone had any response from West Brom to any letters recently.

I have just chased up a response to a letter I sent mid October and a friend is still waiting for a response to his original letter he sent in September for copies of his agreement etc . He chased that two weeks ago and still no response.

I just wondered if they were holding back until we had received opinion

I am still waiting on answer to questions from West Bromwich Building Society

I emailed Holly O'Sullivan on the 14/10/13 and she respond with an email stating she would write to me, I have today phoned in to ask when I would receive this letter to find that she is on long term sick leave and my question was not being dealt with.

I also asked several questions on the 9th Of October by phone to a Gentleman in customer services again I was told that I would be written to re my complaint. As a result of my phone call today that recording was found and it had not been passed to the relevant department for a response

That's interesting . I am sure someone posted on here some weeks ago that a gentleman at West Brom who was in charge of customer complaints or something on those lines was also on long term sick.

Is this an excuse that WB are using as they are buying time, or is it that the pressure is getting to these people ?

I wish I had so much pressure at work I could go long term sick and get full pay . Unfortunately if I did that not only wouldn't I get paid but I would still have to pay these increased interest charges . Now that would be pressure !

If anyone else is still waiting for replies or have tried to contact employees of the West Brom please share on here

It's interesting to consider that the staff being charged with administering all this nonsense perpetrated by WBBS management may not actually agree with it, or even be happy at having to justify it. It's tough in the front line and hopefully our strength of feeling will be recognised by the society's management in time.

Unfortunately having worked in the industry I have seen front line staff end up on long term sickness leave many times when put under pressure from higher up and not resourced.

Imagine if you were in that position with hundreds of angry customers having to justify something you don't believe in. I know a Job is valuable, but if you are a loyal staff member it must be difficult !

Make sure you read their complaints leaflet as it will say the timescales they must reply in and that can be used as another stick.

I don't know whether he is presenting Money Box Live on Radio 4 at 15.00 tomorrow, but he will be presenting Money Box at noon on Radio 4 on Saturday, so there is still time for you to send him emails direct.

In a no win situation trying to appease people in an aggressive frame of mind. I'm sure you'd suffer from stress in similar circumstances. Singling out individual people is little more than bullying in my personal view. As doesn't move the debate forward constructively one iota.

Colin. I'm not singling individual people out. I'm putting pressure on the staff at west brom. If someone is in a job that they can do then having to deal with angry members of the public might be a hassle but that's what they are paid for.

Try waking up in the middle of the night soaked in sweat because your clients or customers are not paying you because there is a recession on. Knowing you need £X in to pay your staff. Having a member of staff leave your business with £35k of clients and £20k of WIP that legally you can't prove. That's stress.

I know it's not the fault of the individual members of staff but at the end of the day they get paid to deal with this. We are potentially out thousands and thousands of pounds because of the immoral way in which their employer is doing business. I don't ask anyone to pay for any mistake I make. But I don't expect to have to pay for someone else's. I resent the reference to bullying. If anyone is being bullied it's the people being made to pay over the odds.

As for moving the debate forward constructively , I'm not debating with west brom or their staff. They are not replying. We need to move forward by getting west brom to reverse this decision. If that means putting pressure on the organisation then so be it. They should have anticipated additional work when they decided to charge us additional interest.

I am looking out for me and my family. If someone wants to come along and try and derail that then I will do whatever I can within the law to stop that. I'm not attacking these people personally but I have no issues in piling on the pressure or encouraging others to do the same as I honestly believe we are 100% in the right here. What happens at West Brom is the responsibility of the people who govern there. I'm responsible for protecting my interests the main one being the well being of my family. DO you honestly think anyone at West Brom really give two hoots to how this effects us ?

I've had a total of 3 replies from West Bromwich so far:

1. Standard reply plus photocopied T & Cs to our initial complaint letter.
.
2. Reply to my second letter requiring further clarification - in which they stated the mortgage broker had signed off the on-line mortgage booking forms to say we had seen and agreed to the terms and condition - demonstrably un-true.

3. On Friday the postie dropped off a package containing around 500 pages and weighing a whopping 1.5kg. This is their reply to my request for personal data, and includes a CD of phone calls and every external and internal document relating to our 2 West Bromwich loans over 7 years (but doesn't show anywhere that we have agreed and signed to their T and Cs). Bizarrely, because I made this request in my name only, they have crossed out every reference to my wife in marker pen and then re-copied each document (even though the loans are in joint names). This must have taken someone literally dozens of hours to collate, redact and re-copy. So it's no wonder that they are struggling to keep up with replying to all our individual correspondence.

I guess the point of them doing all this is so we can't later turn round and make a claim against them under the 1998 Data Protection Act.

Well done to everyone for all their efforts thus far!
