West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

The Money Box Live programme on Wednesday is about Renting and Letting and Carolyn Uphill from the NLA is likely to be one of the guests. I won't be able to call when the programme is on but perhaps other landlords would like to ask a question about the West Bromwich Rate Increase?

Well spotted Anne! I've been directing tweets @Paullewismoney about West Brom's #mortgagemugging but to no avail so far. Wednesday's programme could be a great opportunity to get the subject aired on the radio.

I've just checked their page on the BBC website and found the following contact details for the programme: Call 03700 100 444 between 1pm and 3.30pm on Wednesday or e-mail moneybox@bbc.co.uk now.

If enough of us contact Paul Lewis and the team the West Brom debacle will surely get a mention? If like me you're too chicken to call in live, email is ideal and we can BOMBARD them! And don't forget to mention property118. Anyone else with us?

Still waiting for a reply from my MP, Dr Daniel Poulter........ zzzz.......something to do with NHS waiting times I guess.

Have emailed Money Box this morning, thanks for the link. Further more I await a reply from my local MP Richard Drax. I am pleased to say that the FCA have expressed an interest in several point I have raised with them and I have received correspondence to this effect.

Hi.
I have also sent an email to moneybox and my local MP Mr Stewart Jackson. Hoping to get a response soon. I have also signed the petion on change.org
I have spoken to several people who I know rent out property and as yet have not found anyone who knew about the actions of WBBS. So it seams to me we still have a long way to go to recruit more landlords.

I do hope that our emails get read in time for this week's program but I have to say that previous experience of writing on another matter suggests that it can be weeks before they get around to it - presumably as a result of the sheer volume of correspondence that they receive.

Quick update from me -

Email sent to Moneybox.

Also received a 2nd response letter from the PM well not him personally but another one of his corespondence officers saying he is very busy and can't possibly respond to everyone but that the letters have been forwarded to HM Treasury as they are best to deal with this matter.

No response as yet from my MP to my 2nd letter to him showing the WBBS response and the mention of Section 14 plus the link to the article on the WBBS new Head Office.

Hi Dean

I've been onboard for several weeks now.
I'm in the class action group having paid and sent in my paperwork etc.

I originally found property118.com whilst searching google for West Bromwich interest rate increases. At that time there was about 500 comments on the forum which led me to believe that we could fight WBBS and win and therefore stop other lenders from following suit.
Thanks for everyone's efforts to-date.
