West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Our promise to all who support these values is that we will not sell out on you at any price. We will continue to fight this injustice and we will fight any other lender who tries to follow suit.

The man who organises the Landlords' Forum for the local council has sent the following email to its 450 members:

Subject: A message from a concerned landlord about tracker mortgages

Dear Landlord,

Here is a brief summary of a an email I have been asked to forward around the landlord distribution list by a concerned landlord.

If you have concerns about a letter you have received from West Bromwich Mortgage Company Ltd about your tracker mortgage, increasing the interest rate by 2% from next month, you are not alone; an action group has been set up by the Property118 landlords forum, which now has over 1,000 members. Its press release, with a link to this forum, can be found at:

It is not just West Bromwich customers who are affected. This could potentially spread to other lenders.

He added the advice about seeking an IFA.

If you have not already done so, I would encourage you all to ask your local equivalent to do the same - they can contact a lot of landlords in their areas.

I would add solicitors to the list of people to ask to spread the word. I sent the petition link to the solicitor who handled the purchases of our properties and asked him to sign it and pass my email on to his clients and to fellow solicitors. He told me that he has done so.

He was not involved in the remortgages with WB - I thought my command of English was adequate to understand WB's conditions, and their solicitors were kind enough to look after all the legalities free of charge!

It was very similar to the email I sent a contact at Barnsley Council who organises NLA events in the Yorkshire Area . She has sent it to all her landlord contacts

The petition an excellent way, via an independent organisation, of showing the strength of our support. It also provides several links to Property118's website and its action group.

In addition, the email that Change.org sends you in reply is a great tool for spreading the message, both on Facebook and by email.

It provides a draft email to request potential recipients to sign the petition, and a link that takes them straight there. Then they, in turn will get a draft email to pass on.

I adapted this email and sent it to my broker, my solicitor and several letting agents asking them firstly to sign the petition and secondly to forward my email to their clients and peers.

And it needn’t be limited to landlords and their professional advisers/agents. It could and should be sent to anyone you know who has a mortgage.

This is what I sent:

Hi X

It's a long time since we met, I hope you are well.

I have just signed the petition "West Bromwich Mortgage Company Limited: Reverse their decision to increase the rate on buy to let mortgages which was not noted in their original offer letter and signed agreement." on Change.org.

It's important. Will you sign it too, please? Here's the link:

Would you please copy this email to all your clients who have tracker mortgages, whether they are with WB or not. As Mark says, if WB get away with this, other lenders will try to follow suit, so it is in their interest to support Mark's efforts.

And could you please send it to all the solicitors, brokers and letting agents you know, and ask them to do the same.

All joint owners should "sign" individually, and so should members of their families, as they are all directly affected by this breach of contract.

For credibility we need at least as many supporters for the petition as there are members of this forum. So if you haven't got around to adding your name yet, please do so. It only takes a minute.
