West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I have now written to my MP and Fin Ombudsman as a concerned but not directly affected landlord.

Anybody got any thoughts as to who else I should write to without having a direct case against WBBS?

I too have now added Experian to my list.
My MP said... "I was concerned to read your comments"...and has asked to discuss the matter in person.

Hi Dean,

My mortgage broker 'Mortgages for Business' had been advised of 118's activities and referred me here when I asked if they had a policy should any mortgages they arranged for me be similarly affected. They claimed to have had very little to do with WBBS.

I know the MD of Mortgages for Business very well (David Whittaker). We were once co-directors in UKCFG and founders of the NACFB. We ran for president at the same time - he won - cest la vie!

I had a long conversation with David a few weeks ago as they are a very large brokerage. By pure fluke it would appear they only ever completed 4 loans with WBBS. Nevertheless, David is a great advocate for us to have on board as his network of connection reaches out to pretty much every route and branch of the lender/broker networks. It's good to hear that he's telling people about our campaign 🙂

Just a quick update from me - emailed Watchdog again last night so hopefully they may take notice of us this time and thanks to Dean who hasnt given up on that one.

In addition I sent a 2nd letter to my MP following up on his reply from a few weeks ago asking if he had received a response from the Financial Secretary to the Treasury after his letter to them.

I also included a copy of the final response letter from the WBBS and drew his attention to them mentioning Section 14 - demand for full repayment of the loans !!

Plus I also included a link to the article in the Express & Star on the WBBS building their plush new offices and asked what he thought on that.

Has anyone received a response from the WBBS with regard to the Subject Access Request ?

Hi Mark,
We received ours a few days ago - sent the request on 16th October, so took around two and a half weeks for response. Sent by recorded delivery and around 2 inches of photocopied paperwork and a CD of our phone calls with them.

My details have now gone to Rt Hon Chris Grayling MP via contact form on website (to constituency office) plus full details by letter emailed (to House of Commons). Requested issue be escalated to Treasury Committee. Here's hoping something comes of it.
