West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

We could even do it now in photo format do's anyone know how to superimpose a photo as there new office would look good with imposed landlords picketing, then Email it to WB

WATCHDOG

This Wednesday is our last chance to get a mention on Watchdog.

If everyone could do one short email please to watchdog@bbc.co.uk

They will not be able to do a full investigation now. All we want is a 20-30 second mention . They are doing a piece on Banks on Wednesday. Can anyone help with a few questions

1) On my 'Acceptance of loan Offer' which we were asked to sign, point 1 says
' we acknowledge your right to withdraw the Offer of Loan at any time without notice and to VARY THE RATES OF INTEREST AND MONTHLY PAYMENTS'

Does this affect us in a negative way?

2) I have all corrospondence, offer letters from the West Brom etc but what is the 'Mortgage Deed' that keeps being mentioned?

3) Although my paperwork says the T&C's were sent by WB. Did anyone actually recieve it at the time of the mortgage. I have 3 mortgages with WB and I am very good with paperwork but don't seem to be able to locate this document on any of my mortgages.

We will not know for certain until we get Counsels opinion.

Point 2) - did you send the template letter we recommend to WBBS? If not it doesn't really matter at this stage as I can't see why your paperwork will be any different to everybody else's. Submit what you've got to Justin and if he needs more then that's the time to deal with it.

Point 3) yes I received them and so did many others. I also read them in detail. Our legal argument does not rely on this point, the fact we signed to say we had received and read the booklet but may or may not have done so changes nothing.

Someone asked recently how many people go to the 2-day Landlord and Letting Shows. I do not know, but as they are held several times a year in different parts of the country they must get enough people attending to make them continue.
