Tenant, Neighbour, Agents and the fence?

Hello, My property is with a letting agency. The neighbour complained the fence was not in good repair post winds, my responsibility and my boundary.

I appointed a professional to put up feathered fencing. The neighbour complained to the professional that he didn’t know the fence was going up, and he wanted the nice side facing him. He badgered the professional so much that he stopped work, plus the neighbour refused him to put a foot on his side. There was also a complaint that his wife could have been seen semi-clothed so he wanted notice next time.

Notice was given again, but to the neighbour as well. This time, the tenant refused to let professional access to electricity and complained that the professional has gone into the garden to get his tools the days before. He had knocked on the door, but they didn’t answer, albeit was home. Also, the neighbour had put notes in polypockets dictating where the fence is to go.

Then there’s the agents, by this time I’d had enough. 2 days lost Labour, a load of wasted timber and no further, so I instructed the agents to put up a chicken wire fence. They’ve come back saying they can’t do this because the neighbour has a dog and he needs the garden secure so he can let his cat and dog out!

I can’t believe it! This neighbour is a pain and is sucking in the agents etc in order to get what he wants.

Sick of all of them.

I’m going to change agents or sell it fenceless!

You couldn't make it up!

Wait until the neighbour begs you to put up a nice solid wooden fence and tell him you're paying so you choose which side faces him.

Firstly, is the fence definitely our responsibility?
If it is and the neighbour won't contribute to the cost then I don't see how they can dictate which way round the fence panels go.
Last thought, is there anything in the deeds that say what type or height of fence there should be? If not put up the ugliest one you can find, and if they want a tall fence suggest they pay towards it.

Best check the fence is going where the old one was, or they will play hell that you have stolen their garden.

Thanks for your replies, it's definitely my responsibility/boundary. Although there's absolutely nothing to say I have to put up a fence. Just entirely let down by letting agents over this dictator, you'd think he was paying them. I'd sell up if it wasn't for the CGT, mind you, on the other hand might be worth it if Boris ups it to 40% to pay for the big C word.

He already begged and this is where we are at, he dictated he gets the nice side cause apparently that's what it says on 'google'. Poor fella 😂

I always give myself/property the nice side especially when the neighbour won’t go halves as most sensible people these days do so both parties get a nice boundary.
BUT !!! by rights you are supposed to give your neighbour the nice side if it’s your boundary and you are replacing the fence/boundary 🤷‍♂️ Strange I know but this is what’s supposed to happen, but I’ve never been challenged YET!

it is the neighbours responsibility to keep HIS dog in HIS garden , it is NOT your responsibility to keep HIS dog in HIS garden
as you are paying for fence you can put which ever side you like facing HIM
i know of no law about best side to neighbour

You are not legally required to have a fence (unless a conservation area or building is listed, then it's a planning issue). You could go to court to get a court order for access as there was a fence that you are replacing due to damage but that's a lot of money. I would say they don't get a fence. Write to the tenant and the neighbor, saying as they both refuse to have a fence installed, then one will not be installed. Try to get the tradesperson to collect the materials in return for a discount off what you have to pay him but I bet your letters will allow access.

There is no law that requires the “good” side of a fence to be shown to person not responsible for the fence. That’s a myth.

My suggestion is use fence consisting of horizontal planks attached to uprights. Each level is staggered. One attached your side and the next on neighbour's. This gives a good side to both. Can also be erected from your side without going next door.
