Spouse/Partner Leave to Remain visa?

I have had an application that gives this detail (Spouse/Partner leave to remain) on the biometric card. I have asked for a share code from the prospective tenant. Looking this up on the government website it states: Apply as a partner or spouse

To apply as a partner, you and your partner both need to be 18 or over.
Your partner must also either:
be a British or Irish citizen
have settled in the UK – for example, they have indefinite leave to remain, settled status or proof of permanent residence
be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status – they must have started living in the UK before 1 January 2021
have a Turkish Businessperson visa or Turkish Worker visa
have refugee status or humanitarian protection in the UK.

It goes on to state that – You and your partner must intend to live together permanently in the UK after you apply.

This person is applying on their own for a tenancy in their own name. At this point, I have no suspicions to suggest they are not alone, but the requirements state otherwise.

Any advice from those that are used to such applications?

Hi DSR
Quick question for you: What is the nationality of the tenant(s)? Are they holders of Ancestral Visas?
'Leave to Remain' on a biometric card has a fixed end date. Please double check. Please ask the applicant(s) what this date is and verify it with sight of the card. You need the information from both cards (which are likely to be co-endorsed if the live-together is part of the condition of entry).
Lord
PS: 'Indefinite Leave to Remain' (ILR) is not the same thing. That has to be applied for by the tenant(s) before their Leave to Remain expires.

seen the card. Expiry mid 2024. Nigeria.

Have thrown it back to the council as applicant seems to think LA will be paying RIA and deposit whereas visa card clearly stated no recourse to public funds! LA approached me to house them.

They wont pass financially at the first hurdle so the application wont progress anyway.

In terms of the LA - a sharp reminder they need to check documentation properly.
