Shelter attacks large rise in Section 21 evictions

Shelter has attacked Section 21 evictions as the leading cause of homelessness. 

Chief Executive, Polly Neate, has highlighted the 143% rise in ‘no fault evictions’ recently revealed by new government figures. Up from 792 households between Oct and Dec 2021 and 1,924 between Oct and Dec 2022.

The figures on repossession and evictions released by the Ministry of Justice show 6,101 landlords in England started Section 21 eviction court proceedings between October and December 2022 – up 69 per cent in a year.

‘No one wants to be forced out of their home’

Polly Neate said: “Every eviction notice that lands on someone’s doormat brings with it fear and uncertainty. No one wants to be forced out of their home, but these court figures show that’s happening to more and more private renters in this country.”

She added: “The chronic lack of social homes means the demand for overpriced and unstable private rentals has ballooned, and more people are being pitted against each other in the hunt for a home.

“Every day we hear from desperate families who’ve been served with no-fault eviction notices for daring to complain about poor conditions, or because their landlord wants to cash in on rising rents.”

Additional taxation rules are going to raise the cost for landlords

Despite the apparent large rise in these figures, other factors are at play.

An eviction ban (due to Covid) which was in place between March 2020 and May 2021, reduced the number of cases being heard by the courts and created a massive backlog.

A large amount of upcoming government legislation including a proposed ban on Section 21 evictions, Energy Performance Certificates (EPC) and additional taxation rules are going to raise the cost for landlords.

A report, carried out by Foundation Home loans, also revealed that landlords were more likely to sell a property rated D-E over the next 12 months.

This will decrease the number of private rented homes available and make the problems of homeless even worse.

I don’t really understand, Shelter are giving the Gov loads of nice new regulations to enforce on landlords then wonder why loads are selling up ?

How can she tell the difference between that, and my reason? ie the tenants were a few thousand in arrears and hadn't cleaned the house or touched the garden in years, and I want out of all my properties now because they no longer make a sensible return in a much higher interest rate environment?

Who is Polly Neate "attacking"?
Again its focused on the PRS and not so much at the government for not building council houses. Doe not say what the percentages are for non payment etc, Landlord just wants more money or selling due to having been hammered enough by Shelter, Gen Rent and the government.
Maybe selling for other reasons. No clarification of her (un) reasoning.

Another stupid entity calling themselves Shelter, They should know why S21 is making people homeless, It is not S21 but because there is a reason behind it all, either tenants have not paid their rents and have fallen back accruing rent or are misbehaving or other anti-social behaviour, come on Shelter grow up and acquire some real sense. Find out under what reasons landlords would just evict good tenants if they were paying rent on time and their behaviour was good , why would any Landlord evict a good , on time rent paying tenant? Most probably a tenant who has same attitude as Shelter. There is no free lunch, you pay, you get your goods, or you leave the shopping trolley back and get out. Landlords do not run charity shop or food bank, neither do Shelter.

Poor Polly. Let me add the reason I have served 2 . Section 21’s. The no fault evictions. Lol. She is clueless. . I have served them as my decent regular paying tenants asked me to. They are living in overcrowded accommodation and cannot afford to pay more. Both are on benefits now. They were both in employment and the rent was fair to us both initially. . The rent has not increased in years. They have both had problems and are now on benefits. They have both had children. They are very overcrowded. Getting an eviction is their only hope of getting a decent size property for their families. So I am evicting them at my expense. When they eventually leave to bigger homes I will sell both properties. Mainly thanks to Shelter etc attitudes to landlords. God bless you Polly.

Shelter should try being a landlord. I am retiring I am selling my properties therefore I am issuing section 21 notices. These will be included in shelters false statistics. If the Tory government haven't sold all the council houses we wouldn't be in this position end of story

They will be crying out for Section 21 when they realize that councils will not be obliged to re-house people evicted through the courts.

I read that Shelter receives over £48 million a year in grants,donations, mostly from government. They do not house one person, all they do mainly is denigrate private landlords. Think Polly is on £140.000 a year.

This is very true. The fact that a tenant has been evicted through the courts under Section 8 will be a matter of record readily available. Councils will deem that tenants evicted this way have deliberately made themselves homeless by breaching one or more conditions of their tenancy agreements and won’t help them. Section 8 records will also show up on reference checks. No PRS landlord would knowingly take on any tenant who has been evicted by a court. Section 21 gives the option to the tenant to go quietly and hide a blemished record.
