Serving Section 21 Notices from 1st October 2018

As of 1st October 2018 all tenants regardless of when they moved in will need to be served with a form 6a.

They also will need to be served with the Gas Safety, EPC & How to Rent Booklet.

The Section 21 notice will only be valid for 6 months from the date of service.

If there are outstanding maintenance or repair works you will not be able to serve notice on the tenants or any notice served on the tenant will be invalid.

thank you Michael doe that clarification. Bad enough that the government and media want to frighten us into selling up without it coming on 118 posts as well.

Around 12 months ago I served a section 8 and 21 together to remove a non paying tenant. Luckily I had insured the property against this so didn’t go out of pocket. The insurance company appointed a solicitors who asked me for the rental agreement of course but they also needed to re send the valid gas certificate, how to rent book etc to the tenants as I didn’t have proof I had already given them. In future I will be getting new tenants to sign a document confirming I have given them the gas certificate and how to rent information etc. along with the other documents. As should you need to serve a 21 or 8 it saves much time and hassle as they can’t deny they received all the correct documents when you first hand over the keys.

I agree with Michael about the absence of a requirement to serve Gas Certificates or EPC’s for tenancies before 1/10/2015, but there is a worrying element of ambiguity in the Act and Regulations which might lead you to serve them anyway before issuing a s.21.
