Selective Licence expired?

Selective Licence expired?

Hi, I have a property in a Selective License area and my property was licensed. I have just been checking the paperwork and noticed that my licence expired 2 years ago.

I have been renting during this period and obviously need to get a new licence. My question is the best way to go about it without attracting any fine?

Any advice would be greatly appreciated.

Newham council had to seek further 5 year term approval from the Government (Secretary of State) to continue to implement Selective licencing in the borough, but for some reason the approval was late coming, so Newham council had to inform all landlords that they were waiting for the approval so haven't got one yet so they advised all Landlords to wait for further instructions, they need not renew or apply for a new licence until further notice, however all HMO's are mandatory so they needed to be licenced, then months later they got the approval to continue with the scheme and Newham Council then contacted all landlords to reapply for a licence or renew the old one from a new date for another 5 years term.
The point I am making is the Council is duty bound to keep you informed personally by emails as you would have paid thousands in licence fees and least you expect is a reminder by an email or a letter.

true enough. You can't be expected to pay for something you aren't even told about in the first instance.

I have property in Newham and although I have received a licence for the HMO I have not yet received licenses for the 2 bed houses and these licenses were applied for soon after Newham received the permission from the Secetary of state.
They say that they are still trying to catch up.
Have you had the same experience?

I will be contacting the council and will emphasise that I have had a license, have not been contacted to renew and would like to get another.
See what happens

Have you changed tenants since the license expired? If so you have to give a copy to your tenant so how on earth could only just notice!

Dare I ask what other required certification/ documentation has expired?

Hi Mike, I let in North Yorkshire. My property is currently not under a selective licence scheme (I believe just Scarborough) Is the only way to be up to date with this by remembering to check their website? Would the letting agent be made aware by the council and then pass this on to their LL?

Reply to the comment left by Mike at 12/07/2024 - 11:41While the Council may have a duty to inform landlords, a court would be very unlikely to accept their failure to do so as a reasonable excuse. Ignorance of the law is almost never a defence. Landlords are expected to use their own means to seek out and understand their legal obligations.

The new scheme and its start date will have been announced on the Councils website. Crystal balls are not required for landlords, Steel balls on the other hand may be of more use.
