Sadiq Khan pushes for tougher penalties for landlords over mouldy homes

The London Mayor is calling for tougher sanctions for private landlords who let out mouldy homes in the capital.

Sadiq Khan wants to see rent rebates doubled if landlords fail to fix mouldy and draughty homes in London.

As part of the mayor’s measures, Rent Repayment Orders – legal orders which require rogue private landlords to pay back rent to tenants for various offences – could be extended from 12 months to two years’ worth of rent.

Under Mr Khan’s proposals a tenant paying the average London asking rent of £2,627 a month, could mean a landlord has to pay back the tenant up to £63,000 in rent if found in violation.

Fail to meet Decent Homes Standard

According to research by Generation Rent, private renters in London are disproportionately likely to be defined as ‘vulnerable’.

Nearly a fifth (18%) of privately rented homes in London fail to meet the Decent Homes Standard, with more than 178,000 private rented properties in the capital classified as ‘non-decent’.

A Freedom of Information request by Generation Rent revealed that damp and mould complaints accounted for nearly a third (28%) of category-one hazards in London, posing serious health and safety risks.

Incidents reported to London councils were more than twice the proportion seen across England.

Building a better London for everyone

Alongside proposals for tougher actions on landlords, Mr Khan has also announced a new mayoral initiative to help deliver training for borough environmental health officers to tackle damp and mouldy homes.

He said: “The provision of adequate housing is critical to building a better London for everyone and every single Londoner should have the right to a safe and secure home.

“That’s why I am funding the training of specialist officers to ensure homes meet a decent standard and why I am determined to see much tougher penalties for rogue landlords who rent out private properties in poor and dangerous conditions.”

He added: “This action can only come from the government, but the Chancellor’s Autumn Statement proved a missed opportunity to clamp down on sub-par housing, and invest in the delivery of more high-quality, affordable homes.”

The Mayor also repeated calls for an immediate two-year rent freeze and to immediately pass the Renters Reform Bill, including the removal of Section 21 ‘no-fault’ evictions.

Mr Khan says he wants to ensure that renters aren’t deterred from reporting damp and mould due to the risk of retaliatory eviction.

So another recipe for even higher rents, If Landlords will now have to visit their properties every month with a bottle of bleach and bucket and a ceiling mop, we will have to wipe clean all surfaces where mould might be growing. This will sure add to costs and so have to reflect in our rents.

Reply to the comment left by Ma'at Housing Solutions at 30/11/2023 - 12:32What Action do you suggest the Landlord takes when s/he advises the tenant HOW to stop damp and mould BUT the tenant: 1) ignores the LL's advice, 2) refuses to use the equipment the LL provides, 3) disconnects the LL's anti-mould device from the electricity, 4) refuses to open any windows or other ventilation facility provided by the LL that will STOP damp/mould forming ??? I look forward to hearing your suggestions (and Khan's).

If the LL has photographic proof that the property was let in a clean and habitable condition, showing that the mould has appeared only since the tenant has lived there, and no leaks or water invasions have occurred from a leaky roof etc during the tenancy, what then? How can the mould be the LL's fault?

Has usual Khan hitting landlords, socialist traits. Does it take into account the life styles of the tennants who consistently block vents up ,leave central heating off , dry clothes when heating on and fail to reporting problems and not allow landlords entry. To inspect property, fear a avalanche of mould related claims comming landlords way.

Khan and the councils are not concerned with the problems of air pollution, or mould in houses or any problems really it seems. Their main concern is how to balance their books. It's the same with TFL. Where can they get more money from to pay for all their pet projects and expenses etc?
Well the Marxists have found a great way to solve this finance problem. First look to see what problems there are, let's say air pollution or mould. Secondly weaponise the problem and charge a fee from people who can be easily blamed for causing it. (Bring in the ULEZ law and fine the landlords), and that have money that can pay the ridiculous high fines.
It's a stepping stone for binging in a lot more cash. If they really wanted to solve the pollution problem, they just need to ban the vehicles that cause it, but that wouldn't bring in all those £ millions would it. Same with the damp houses. They just need to employ experts who can fix the problem and then charge whoever's caused it, either the tennants or the landlord. But that won't bring in all that money from fines that they are getting.
The govenment are at this very same trick. Allowing in millions of illegal immigrants, and cause a housing crisis, and then punishing landlords for raising the rent due to lack of supply of housing.
And when there isn't a problem, they create one, and charge fines claiming they are solving it.
Look at parking. We used to park for free. Now we have to pay the council £200 a year just for the privilege to park our cars. I expect that will be going up each year, if they can get away with it. It hasn't solved the parking problems, but the councils sure do make a lot of money out of it.

We had tenants that tried to name and shame us on the radio for the mould appearing inside the property. At this point we had already fitted additional insulation and ventilation and informed the tenant that drying clothes indoors with the windows shut will prevent the moisture from escaping causing the mould.
When the radio program went to air they had an independant rental expert on the line who shot the tenant down in flames for basically ignoring advice and blame us the landlords.
Once those tenants left I also fitted a positive input vent in the loft. Also the property has a conservatory so suggest that tenants use this space to dry clothes inside rather than inside the house. Never had a problem or complaint since.

Want small state low regulation government vote reform all excessive regulation does is push rent prices up I have been a landlord for 20 years I know lots of landlords I have never met or heard of a rogue landlord the way these out of touch cretin mp’s go on about it you would think they are everywhere when they are not. Black mould mr khan is from excess moisture and not airing the property. The worst offends are the government social housing schemes from what I gather. The PRS needs an attack dog representing up not the NRLA that always says we welcome the regulation we don’t welcome useless red tape.

What happens when S21 is gone. You rent to a family with the correct number of people.
The family then gets bigger either via birth, step children. This will create more moisture by the additional number.
You won't be able to evict unless it's added to S8?
