Propertymark guides Welsh agents on new building safety rules

Propertymark has collaborated with the Welsh government to produce an in-depth guide on building safety for letting agents operating in Wales.

The guide aims to help agents understand the new rules and how they impact freeholders, leaseholders, renters, homebuyers and sellers.

The Welsh government is implementing new requirements for multi-occupied residential buildings, regardless of height, which go beyond the UK’s Building Safety Act 2022.

While the Act applies in Wales, the Welsh government is establishing its own building safety regime to best reflect its plans to ensure resident safety.

Important that property agents understand the rules

The organisation’s chief executive, Nathan Emerson, said: “We are very pleased to have worked with the Welsh government in putting together our guidance for our members, and for all agents in Wales.

“Given the seriousness of fire safety, it’s vitally important that property agents understand their roles and responsibilities and where devolved regulations apply.”

He added: “This fact sheet will provide agents in Wales with a good understanding of the legislative changes that have taken place since the Building Safety Act passed in 2022 and the forthcoming legislation planned by the Welsh government.”

How building safety is managed

The upcoming Building Safety (Wales) Bill, expected to be introduced by July, will impact how building safety is managed.

Property agents, particularly those responsible for entire blocks of flats or working with management agents, must be aware of their obligations under these new rules.

Propertymark’s fact sheet highlights key differences between English and Welsh legislation, helping agents in Wales understand the specific regulations that apply to them.

It explores areas such as the role of the Building Safety Regulator and the distinct approach the Welsh Government is taking to building safety.

Building safety in Wales

Jayne Bryant, the government’s cabinet secretary for housing and local government, said: “I’m so pleased that we’ve been able to collaborate on this fact sheet with Propertymark to provide an overview of building safety in Wales.”

She adds: “In Wales, we already have an extensive programme of work underway to address both external and internal fire safety issues, ensuring residents in Wales can feel safe and secure in their homes.”
