Proof required of cigarette or weed smoking?

I think it is highly likely my tenants are breaking the terms of the tenancy agreement

I am looking for the best way to prove they are smoking cigarettes or weed in the house.

I can smell it, but I doubt that is proof enough.

What do you think I should do to get irrefutable evidence?

Hi Emma, essentially it's your property and you set the standards acceptable to you with regard to what is acceptable or not. You have reflected this in the tenancy agreement and you must always stand by this. Cannabis is often the beginning of a slippery slope towards other harder more addictive drugs, simply because the supplier will at some point begin pushing other drugs that are more addictive (guaranteed returns) and profitable to him/ her. From a tenancy agreement perspective, if the tenant ignores some of their obligations and they get away with it, what others will be ignored? I would discuss with the tenants and back your suspicions with a warning letter. Any future indication can be followed up with a no fault section 21.

Had the same situation. My issue was though that the weed smoking was causing other tenants problems - smoke smells in their flats etc. I had to give the chap in question a S21 simply as it was starting to escalate, some of the tenants confronting him, all getting a bit uncomfortable etc. Despite giving him a S21 I did though add in a letter to tell him why. He was a model tenant as duch - been with us for years and rent fully paid by HB so I didn't really want him to leave as you never know what you are going to get in his place! No smoking is in all my contracts too, but I will be honest I would have kept him on (if there had been no other complaints) and just sent him a letter to say I am aware he is smoking and ask him to stop as it was against his tenancy and ergo at the point he did leave that his full deposit would be in jeopardy as I may need to replace the carpet if it smelt of smoke.

Currently, I've experienced tenant/s who lied on their reference, clearly indicating that they're non smokers when in fact they were chain smokers.

The problems Im facing are as follows;

1. I'm a non smoker and I'm constantly inhaling their nicotine through second hand smoke (SHS).
The risk from the carcinogens and side stream smoke, some of which are at higher concentrations than direct smoke can effect other residents who don't smoke."
2. It's a clear breach in accordance with the terms and conditions of your Tenancy Agreement.
3. It can invalidate your insurance.
4. Carcinogens from tobacco smoke can stain your walls, carpets, upholstery and curtains.
5. It costs a lot of money to remove cigarette smoke completely from a property.
6. In order to eliminate the smell from SHS, I've had to purchase X2 air purifiers at £100 each.
7. Smokers lose their sense of smell and taste, so when one complains, their not really sympathetic to your concerns.
8. SHS can affect asthma sufferers and young children
