Need help with Leaseholder Deed of Certificate?

Hello Folks, Are there any landlords out there being asked to provide Leaseholder Deed of Certificate by ground rent management Company due to the Building Safety Act 2022 and associated regulations?

It seems quite complicated and I’ve not got a clue about it.

Has anyone managed to complete it?

Any advice will be much appreciated!

We have been asked for an asbestos report for the common parts. I have supplied an assessment and told them they need to pay if they want a full report. If there is any asbestos there it is more likely to be in the flat than in the common parts. It is a Victorian building converted into flats in the early 80s.
Is it common to do asbestos assessments in such circumstances as a routine matter. First I have heard of it.

Not sure do we need to fill in this one too? as it seems very complicated.

Reply to the comment left by Kin White at 07/11/2023 - 11:01Yes that’s the exact form that I have had to fill in. Just work your way through it. You then send it back to your freeholder who will issue you with a certificate which states whether your lease is qualifying or not.

I have had a request for asbestos report in a block built in 2005, when asbestos was outlawed in 1999/2000 as far as I can remember. Solicitors now just seem to be covering themselves and ask for anything they can think of.

Yes. I think that is the case. I was asked for a party wall award for works done well before the party wall act!

It's worth clicking through the links to gain a better understanding of what is being asked if you.
It's seems under the new legislation flat owners may be exempt from certain works that are historic in relation to cladding and fire safety.
First, you will need to ascertain if you're building applied under the legislation. ie buildings over 11 meters high etc.

The form you need to complete is the “Leaseholder Deed Of Certifcate”. My freeholder sent me this form with a covering letter which gave me a date by which I needed to complete and return it to them. Seems odd that they haven’t sent you the form. I expect they want you to download it then. It’s not really a certificate it’s more of an application form, a statement of your property ownership details. Print it off and send it back to them a.s.a.p. Any queries with the questions give me a shout 👍
