My battle with Rosinca formerly Mortgage Express?

I’m about to start a battle with Rosinca Mortgages. Today I woke up and opened a letter from Rosinca, and  I am incandescent because they’re threatening to repossess me. My calm response to my distressed daughter was “Sweetie – let them bring it on”.

Why should we innocent customers suffer? As far as I am concerned if they can bail out the banks – they can bail out us victims.

There was also no consultation and I don’t recall signing a contract that said that Mortgage Express could actually move me over to another organisation without my permission and express consent. So I will battle them. As am sick of it.

I took out my B2L in 2005. Key was to consolidate my two mortgages (the other was a residential mortgage) as a single mother.

After the bailout I was shocked to discover that I lost my right to actually swap my buy to let to a residential mortgage.

Well these debt book vultures as I call them – picked the wrong person to fight. Rosinca (sorry Topaz) bought the B&B Mortgage Express mortgage book so cheap, yet they’ve not given us customers any concessions.

Under the Unfair Contract Terms Act as well as possessing an invisible disability as a victim of crime – hence the Equalities Act comes into play – I am going to fight them.

What I now want is a financial forensic timeline of how we all came to be owned by Topaz Finance Ltd – trading as Rosinca – owned by Computershare

1. Two amazing men fighting Mortgage Express (now called Rosinca).
Can anyone help me trace them?

3. Topaz is owned by Computershare. Some say they are greedy, run by a bunch of accountants I believe some of whom live in USA.

CONCLUSION

Given this pandemic, it is time property owners stood up. Many of us are purchased properties as pensions. But we were screwed over by successive governments and while everyone else danced and binged – we have been left holding empty purses, with human hooves trampling all over our financial wellbeing.

I’m looking for anyone else who I can perhaps help.

I’m also going to set up a Facebook forum for us, and if necessary at some point we will consider a class action. As together perhaps we can fund a legal firm to represent us? Let me know what you think. Whether or not I get anyone is irrelevant – I fight alone as my Dad taught me from the age of 6 how to fight back when I see dodgy goings-on.

We have lived at our current address for almost 40 YEARS. Last year we were horrified to discover that LAND REGISTRY had our residential/correspondence address as being at the our buy-to-let" property - and LAND REGISTRY sent a letter to that address when we paid off our mortgage on that property.! We then checked Land Registry website and found that the same to one OTHER buy-to-let property where we still have a mortgage with Rosinca.!
Both of the mortgages were taken out with MORTGAGE EXPRESS -whose business was transferred to Rosinca/Topaz!
We had taken out a couple of other mortgages with Mortgage Express but paid these off BEFORE their business was transferred to Rosinca - and these still have our correct residential/correspondence address.
We are confident tht the occured when Mortgage Express business was transferred because we had an earlier printout of Land Registry's record before the transfer - which then showed our correct residential/Correspondence address.
When we reported this Rosinca AND Land Registry were NOT helpful. - and told us to complete a change of address form COG 1 - which is not helpful - because as part of their process LAND REGISTRY send a letter to the "former" address (ie to the address of buy-to-let property. ( Even Post Office change of address appears not to be so simple)
I you don't have a good relationship with your tenants they may never forward it to you - and you may never be aware of the error on Land Registry's records!

I am having issues with Topaz one ten year mortgage came up and I renegotiated to reduce all my others to 10 years and overpay 1k per month and sell one a year. I am now planning to sell all the topaz properties over the next 5 years as they are all underperforming anyway. I do believe buried in the small print they where allowed to sell on loans it’s pretty common amongst the corrupt elite.

If anyone wants to know more watch a documentary called the inside job about the 08 financial crash. I am clued up on the stock market these days and at one time multiple hedge funds owned the same mortgage packaged up as CDOs. This was a Massive fraud that brought down Lehman brothers and many others. The true fact is you don’t know how high all the financial corruption goes certainly it was at government level in the states so I dare say it will be like that over here
That is why I am selling up quite a lot of property over the coming years and paying off loans to have a small portfolio with no debt. We haven’t got any friends in this game and I don’t trust anyone.

By the way I can't remortgage. Because I was in an IVI but this was after I was mis-sold. Also I haven't breached the terms as I am living here under their permission. As I'm slowly redecorating.

We have just issued a counter claim for misspelling and malpractice throughout Bt he term.

Hi Yasmin I have again read your issues with Topaz Rosince I have endured problems with the company now for 2 years they having agreed to renew my contract October 2019 and by December 23 I received a letter from my solicitors telling me the lenders had withdrawn the offer no reasons given they have threatened me whilst their agents valued my property for the offer returned informing me that the property was unsalable due to the "set up" my owning the freehold that I must move out of my GFF so that the whole must be auctioned I continue the fight
I found Computer Share in 2016 at an address in India and that they also ran the deposit holding company (Government License) operating from Bristol I informed the then Chairman of the RLA (now joined to NLA) the RLA were unaware that the Deposit company running the scheme was owned by Computer Share ! so I wonder where the deposits for many many Landlords is really held ?

I would be interested to speak to you if this is still going on. Is there any legality iin the point that they have transferred your mortgage without consent.

Hubris is a dangerous emotion. I suggest a little more humility and try to understand if you've breached your mortgage conditions, in which case there are consequences.
