Hello, I’m a new landlord with one property. Can Property118 readers please advise I have not put the deposit in a protection scheme as I didn’t know about these schemes.

Is it better to return the deposit as I don’t want to get penalised at a later date if something goes wrong? I’m hoping my tenants will stay for a  few more years.

Any advice would be very much appreciated,

Reply to the comment left by Peter at 27/06/2023 - 10:09It's worse than that. I stupidly allowed a tenant to rent my flat 18 years ago with NO deposit. When I asked for my flat back in December 2021, he refused to leave. I took him to court under Section 21. The Willesden County Court judge looked at the 18 year old agreement where it clearly stated there was no deposit and declared that, just because the tenancy agreement stated there was no deposit and was signed by my tenant as such, does not mean there was no deposit. He then threw out my case because I had not protected the fictitious deposit ! The case has since been reinstated to Feb 2024!! Absolute truth! What a fine example of British Justice this judge is. If my case is anything to go by, judges are bending over backwards to stop evictions, up to and including inventing evidence with which to decide cases in the tenants favour.

Reply to the comment left by TJP at 01/07/2023 - 20:53Interestingly, you can complain about the way a judge or magistrate conducted the hearing. You cannot complain about the actual decision. This could mean that two different judges give opposing decisions on the same set of circumstances. Justice eh !

Reply to the comment left by GlanACC at 01/07/2023 - 21:09I did think about complaining. But past experience tells me that the judiciary stick together in much the same way as thieves do. And they don't 'entertain' non-legal people interfering with their God-given powers. In my case the judge announced he had 10 minutes to decide the case. He then invented the evidence he needed to stick to his 10 minutes. Justice was the last thing on his mind!! This after a 7 month wait. Since then, my section 21 has been deferred a further 1 year and 5 months to Feb 2024. I now understand why, despite the will of the people, thousands of illegal immigrants can jump on a rubber dinghy and paddle, unhindered in to this country. The pompous asses who sit in judgement of us can scupper the law they claim to represent, with impunity.

Ok guys.... so given that unfortunate situation would you recommend Sandra return the deposit to the tenant or deposit it in the TDS? The main point here is Sandra seems to think that if she returns said deposit that's the end of the matter (given her ignorance of not knowing about the TDS!).
