Landlord’s post threatening repossession?

We currently rent our home via a local estate agent, but we keep receiving letter for the landlord to state she is in arrears with the mortgage.

We have contacted our agents who keep saying they struggle to contact her and when they do she advises them everything is fine, but the latest one states if not resolved the property can be repossessed.

We have contacted our agent to request early termination and waiting to hear back as this is the 7/8 letter we have had this year.

I don’t believe she has notified her mortgage company that she is letting out the property as they are addressed to her at the address we live at are we entitled to contact the mortgage company to advise we rent the property or not?

Would we be entitled to terminate the tenancy agreement due to the letters?

Any help would be greatly appreciated.

It sounds like a distressed owner who has a problem in renting it to you.

Remember that if the mortgage company repossess you will be thrown out on the spot with your possessions. The fact that you are a tenant makes no difference.

Although it pains me as a landlord to advise you to leave straight away, I would consider it. Give notice and get the hell out.

An alternative is to stop paying rent. The landlord might start eviction proceedings which will allow you to get out. Of course, settle up for everything you owe at the end.

Also, if you are receiving letters direct to your property suggests that the landlord may not even be legally letting as a landlord and could be on breach of hismortgage terms and conditions.

All lenders require a Court Order to evict you. Simply put your case to the Court, having taken the steps I advised asap.
