Landlords issue ‘veiled threat’ to evict tenants over Section 21

A representative of the Renter’s Reform Coalition who was privy to government conversations involving tenant and landlord groups says landlords made a ‘veiled threat’ to evict renters.

The head of the organisation, Tom Darling, says that in one meeting, landlords said they would act before the Renters’ Rights Bill came into force to use Section 21 possession notices.

Once the Bill becomes law, Labour says it won’t wait for the court backlog to be cleared but will ban Section 21 ‘no-fault’ evictions immediately.

The campaigner says that landlords told Matthew Pennycook, the housing minister, that before the law is enacted ‘a wave of evictions’ will take place.

‘One last arbitrary eviction’

Mr Darling told the Metro newspaper that the landlords are making a bid that is ‘one last arbitrary eviction just to feel something’.

He was speaking at a fringe event at the Labour Party conference in Liverpool and reportedly said: “I won’t mention their name.”

He went on to say he thought the comment was ‘remarkable’ and ‘shows why Section 21 needs to be abolished in and off itself’.

Mr Darling then explained that the situation for evicting tenants is ‘ridiculous’ because landlords feel they have the power to issue such a threat.

Making threats to evict tenants

He then pointed to social media and landlord forums where he says that landlords are making threats to evict tenants before Section 21 is scrapped.

Mr Darling told the paper that he thinks this is ‘slightly psychotic’.

The fringe event was organised by the coalition after deputy Prime Minister Angela Rayner told delegates that the Bill would ‘rebalance’ the private rented sector.

Hi Alison,
As far as I know, your agent is correct, if you serve the 21 on 27/1/25 the court will void it as you cannot serve it to start before the end of the AST finishes.
The tenant can get most things wrong, you MUST get everything right.

Hi Gary. I thought has long as the end date on the s21 is on or after the last day of the fixed term you can give more than the minimum two months notice?

Hi Alison, Unfortunately, no. The start of the eviction time must not begin until after the termination date of the AST, therefore your section 21 cannot begin until the end of the AST, giving the 2-month notice period, the earliest time you can successfully and legally serve the section 21 is 2 months before the expiration of the AST. Trust me, I have had a case thrown out because I got the dates wrong, this is most frustrating and very annoying when you have the delinquent tenant grinning at you and giving you the "V" sign in court.
You don't want this, believe me, it really tests you as a professional.

LOL, you are assuming that this process is fair and equal, it is not. As I said before, you will have to get everything legally correct or you will fail. I would give at least a day's grace space just to make sure. You will not get any benefit of anything, this will always 100% go to the tenant.
You are now seen as one of the "unclean" or an evil Landlord, do not expect any leeway, or you will be disappointed.

Hi Guys,

I could only start eviction proceedings after the three months notice period.
Just to give you an idea of time - 1st April given notice - should have left end June.
The assessors ( who you are not able to make contact with)that are based in Glasgow for the whole of these news laws in Scotland have still not even given me permission to evict yet….. I have had to provide proof I am refurnishing the flat plus the tenants asked us to evict them so they could get on Council housing list in the first place - it’s absolutely crazy…… and spent the last six months wrecking the flat -

Hi Fiona,
I am unfamiliar with Scottish law, but yes, it is in a tenant's interest for an English LL to evict them if they want to qualify for a council house. Eviction makes them homeless and then they qualify for the council house. They are probably wrecking the flat to make sure that you evict them. They will not have any sympathy for you whatsoever, their only goal is to get what they want, and you are merely the vehicle towards that goal. In their minds, If they can get that council house and it makes you bankrupt, then you will be bankrupt, it is as simple as that.
You are at war with these people, and the system, and must act like it, or you will lose and go under.

Yes I can imagine how annoying that must have been. Back to more training for me lol.

I’m doing a routine visit next month. Hubby thinks I should inform the tenant we are selling, it may push him along to secure something else. He expressed he was looking a few months ago. I think with tenants you have to be considered with your approach. It’s difficult to change from bing transparent but wondering if this would jeopardise rent payments?!?

Actually, I can. They probably thought that it was not good enough for them, they probably wanted a better one. It's sick, but it's reality, it's not the first time that I have come across this situation.
