I want my land back but will the council let me have it?

Hello, The footpath that runs along the side of my house is on my deeds. This was left as a right of way for a road to be built between the gap in the house in 1936 which has never happened.

I would like to have a driveway installed but the only way to do this would be for me to have the land back which is 2 m wide and 70 m long.

Would I be in my rights to try and claim this back from the council?

I am sure you would be able to take out insurance for this kind of thing by a one off payment, this is not an unusual situation

sorry Ian another brain pick...

There is a piece of land at the side of our property. We assumed the retaining wall between us and the neighbour was the boundary where his garden ends and our land starts. The neighbour says that his land ends at his fence line (which is in front of the retaining wall). As a result we have a slither of land that is 'no mans land'. Its overgrown and dense and needs chopping back as the vegetation is falling all over our side only (the land in question is on an incline and we are positioned at the bottom of the hill.)

He has agreed he will cut anything back in his garden that is going over his fence, but we need to come to some arrangement as to who owns the no mans land. My deeds don't clarify anything and his neither although there is a line that suggests the retaining wall is the actual boundary. What the best way to determine who's land it is exactly? Thanks
