Facing council tax harassment despite tenant payments?

Hi, as a landlord, I’ve had a flat rented out since October 2023, with the same tenants occupying it since then. The tenants are registered with the council and have set up a direct debit to pay their council tax.

However, I’ve been receiving harassment from both Birmingham City Council and the Equita enforcement agency to pay council tax for the same property starting from October 2023.

I sent the tenancy agreement to the council and Equita they are still continuing to harass me I don’t know what to do. I have evidence of tenancy agreement and bank statement from the tenant showing they are paying the council.

Any advice would be greatly appreciated.

Only 1 Council Tax can be charged on a property per day. If enf agents are pursuing you for same period as your tenants are being charged for then something is wrong. No council tax system exists that can charge the owner and tenant for same period for same property. If you speak to your c tax dept you can get them to confirm period of charge to make sure it's correct. And you can make sure so your tenants are registered at your property.

Even at this stage it can still be contested as debtor can claim he never received the paperwork from the court, believe me it does happen.

Tenants moved out and I swiftly had notices of unpaid council tax and threatened with court. I wasn't getting the letters because they were gong to the property address, not to me. Then one day 'boom' in the post, I got a court summons. I've never known anything like it. Just make sure there isn't a gap from when the last tenant left and the new one started... and if they are pursing you for that bit of council tax.

I paid it, it got sorted out. The agent got me a new tenant quite quickly, but these handovers can be where gaps happen.

I wish they had the gusto to act as swiftly on fly tipping and anti social behaviour as I've seen them act when the council tax is late!
