I have been a private tenant for 25 years, living above a commercial premises. 

Totally out of the blue 3 weeks ago we received a section 21 notice from our landlords solicitor. I would like to point out here that we have ALWAYS paid our rent, council tax and water rates.

Anyway, we have received this devastating blow, legally it appears we have not a leg to stand on but surely morals and fair play as well as common sense should prevail here?

I am not asking my landlord to allow us to stay, if he wants us gone then that is his decision, but I strongly feel that he should offer us something in the way of compensation.

1) How the hell am I supposed to pack up 25 years of my life, hold down a job and take care of my son who has a disability in just 8 weeks?

2) Why should I have to go to the expense of storage fees and removal fees, not forgetting to mention the hefty agents fees, deposits and so on I am expected to pluck out of thin air?

3) We have very recently (last 6 months) decorated throughout, new carpets and stuff and it leaves a very bitter taste that our hard works and efforts will be enjoyed by somebody else.

Am I being unreasonable do you think?

I have written to both solicitor and landlord asking them to withdraw the section 21 ..I await their reply.
Will let you know in due course the outcome.

Well i have had a reply from my landlords solicitor
Saying " without prejudice to the section 21 notices that have been served blah blah blah our client has found no record of you living in the property from ******* so do you have any documentation to support you have lived in the property since ****

I really do not know what to make of this , i am unable to speak to shelter until friday .....

Sounds like they are on the back foot, clearly they haven't got the paperwork and without it their notice isn't valid.

Go to the local library and check the Voters Roll records from 1990/91/92 & 93.

Contact your bank to see if they can provide copy statements from that time showing your address.

Contact doctors, dentists etc. and pay them for a professional witness statement confirming that you were registered with their practice at your current address at that time.

If you are able to obtain all or any of this information then they will have to produce their paperwork for the corresponding time period or accept their notice is not valid.

Mark thanks ,
I already did that , apparently electronic records began in 1992
I Have written conformation from my GP , local authority ( council tax )
Energy sup stating when i first registered / paid
But do i share this info with them , i feel like i am being lead into some kind of trap !!
Stressed to the max
