Court hearing date Aug 2022?

Hi, I waited for over a year for a hearing date to recover possession from my ex-tenant with arrears.

Originally the hearing date was last week, but the Judge was ‘busy’ so I’ve been given an adjourned hearing date of August 2022 at Medway County Court!

Is this the timeline experienced by others due to the backlog?

The courts system is a mess, more lately. Covid further broke what was already broken! It was would ridiculous of them to adjourn it for another 10 months and I suggest you make a formal complaint. Good luck

I would definitely make a formal complaint.
The whole thing is scandalous.
If the government is going to make rules that govern repossession then they need to make sure that an honest landlord complying with the rules is able to get their property back without losing money for months and months.

I feel for you 🙁 I have a Freeholder who is not Managing my block adequately since 2017. There is a two and a half year leak in the middle of my tenants lounge/kitchen.
In my tenants words 'When it rains outside, it rains inside as well.' I applied to court in early June as the Freeholder will not even allow me access to the roof for a surveyor to locate the leak. The court sent it to a tribunal court yet we still have heard nothing. The courts are meant to support and protect vulnerable people from uncaring people like my Freeholder!

I am in a similar situation and just about to instruct my solicitor to commence High Court proceedings. I lost my tenants 2 years ago in Jan 2020. Only freehold property for me here on in....or sell up completely. Very stressful.

Paying tenants to leave is quickest way to get them out. Sounds awful but when you add up time, solicitors fees, court costs, loss of rent, any judgments (which could go against you if anything hasn’t been served correctly) and then paying for bailiffs to evict is an expensive, time consuming and stressful experience. The government is totally against landlords, I am not sure why. It should become a criminal offence if a tenants doesn’t leave after a 4 month section 28 notice. With eviction enforcement straight away. They quickest way to get people out is to offer them ‘cash for keys’. Sad but true.

It might be the quickest, bit if word gets around that Landlords will do this, it becomes a self serving prophesy and tenants will sit tight until they get their 'reward'.
The system is not fit for purpose, and the reason I am leaving the NRLA is because they are doing nothing to sort this.

Perhaps an up to date lawyer may advise if 'self help' may still apply to have you send your surveyor to the roof to see what is wrong and report? You cannot be expected to sit on your hands while your property suffers preventable damage but still be expected to pay your rent and management charges on time and in full ?

Have you tried talking to them? I have dealt with Medway County Court on several occasions over the last few months and each time I have found the staff to be really helpful and doing their best under difficult circumstances. (Not least that the Lease on Court building expired and the building has been sold, so the Court is temporarily housed in a local hotel.)
As with all these organisations, you have to hold on the phone for a while before your call is answered - but do try a civilised conversation with the staff first. They may be able to help.
They probably get a load of abuse and are not personally responsible for the delays.
