Can you help me with N325?

Hello, I have been granted repossession and been provided with a date (12th December) for eviction and awarded Rent Arrears and court fees.

Please can someone assist with what the sums I should fill out in section 4 (Warrant Details) – is it even worth filling this out? I sense the Bailiffs will focus on eviction and I will have to go through separate process for costs.

The details are:

Rent Arrears – 13,450
Court fee – 355

Monthly Rent – 1375

A – 13,450 + 355 + additional month rent (1375)
B – 13,450 + 355
Issue Fee – 130 (N325)
Total – B + Issue Fee

The box underneath (If the amount of the warrant at (B) is less than the balance at (A), the sum due
after the warrant is paid will be) – should this be additional month rent + issue fee?

Describe the land – is this the type of property etc of just the address again?

Can I apply for the N325 now (knowing tenant won’t leave) or do I have to file on 13th December?

Hi. You have to wait until midnight on 12th December before you can file the N325 for the bailiffs.

Thank you Judith and Marie for your help.
One other issue the court granted repossession on 28th Nov for the tenant to leave by 12 Dec - however I have not received any official repossession letter and the online portal has not been updated either.

I have tried calling Willesden court and they can’t help and asked me to email enquires team - any guidance here would be appreciated too.

Yes - it took about 10days after the judge granted repossession to get the letter and portal to be updated.

As expected the tenant didn't leave on 12th dec, and so i had to wait until after midnight and you will then have the ability to submit a N325 via the portal.

I've now not received any further communication - been told just to wait for a enforcement date - if anyone knows typically how long this takes, please can you let me know - the courts don't give you any information.

Hi Vikesh,

The court date for the tenant to vacate the property is 20th Feb and I want to prepare and apply the warrant of possession online however I’m unable to see that option available. Do you know who I should contact? Or will it appear after the midnight of 20th?

You have left it very late, possible too late, to do this. Contact your county court asap for advice. But it would be better to look at the gov website on evictions etc.

Most important, make sure that you have followed all the legal steps BEFORE you apply. if not, the tenant can complain and possibly get to stay on/

Don't be put off by what you read, you can do this, I did it. Eventually, I had to get the bailiffs in, but sometimes we have to do these things. Good luck

Hi Eddy,
At midnight post 20th Feb, you will have the option to intrauterine bailiffs by filing the N325 form via the possession portal or if you have done this manually via post.

Did you use PCOL to issue the warrant of possession? Have you got the option available after the possession order being granted?

I can’t see that option from my online account so I am going to post the N325 form to the court to apply for bailiff.

Thank you so much for your reply, I’ll keep an eye on the online portal on 20th Feb midnight.

Which court did you apply for? It’s such a long wait. I bet it’s very frustrating like mine does. The law system for tenant eviction is so unfair for the landlord.

I’m applying through Oxford county court and I was told by the bailiff office that bailiff appointment usually take 3-4 weeks after the warrant is issued.
