Don't underestimate HMRC to catch him out. They are going for his types. Some enquires with letting agents. Land Reg enquiries. Council tax lists. Electoral roll search. Etc. then enquiry time . It is just a matter of time.

Problem is I don't blame him or hate him. I am not suggesting the properties are bad. I bought a fridge-freezer that was near new that he did not want any more - he was renting what looked like good places to be honest.

I only declared our rentals and income because i thought i was running a business and that it was the right thing to do. - Turns out I was the idiot!
Turns out I am not running a business and had i have not declared I'd have a good future, would have a bunch in the bank and would not have had the nonsense I have so far jumping through rediculous anti landlord hoops.

when they catch him, IF they catch him he'll pay a small fine, and still be able to sell without CGT etc... No I am clear how the suckers are in this debacle and it is not him!

You cannot justify what he is doing is right. What you feel now is justified anger at the government and you are not alone.
As has been said. Legal challenge, lobbying MPs and raising awareness and getting anger spread and making it be known they have got this wrong.
Government is currently out of control and in dictating mode. However, as we know, they talk bull

From what i saw, he is providing good homes for people - just like us. He is paying his mortgages - just like us. He is spending on upkeep - not like us. He is and will continue to be able to provide for his family unlike us - He is happy and content and unworried - unlike us. He was doing no harm just like us and no harm will come to him - unlike us...

He was smart enough not to trust the government to be fair and reasonable and he took what turns out to be the correct decision; that his finances were his first obligation. He will have the assets and or the wealth to pass on to his children - unlike us.

I am certain that the perception of what is "right" is very much questioned when you are faced with a tyrannical government that will take all you have and your family's future... What is "right" is a very British outdated concept I am afraid. It may be illegal but it may still be the right thing to do - as Tenant Tax and not declaring proves!

With respect, what is "right" is just a warm place in your heart that make you feel good about yourself. It is not a truth or factual constant upon which a decent society is founded. - Bit deep!

PS: He is also probably reading the ESPN website and building his fantasy team in his spare time not what we are doing! He may well just be RIGHT!

Well given the government deny legitamate business expenses and see it ok to make people pay tax when they have not made a profit then I have no come back to that other than 2 wrongs don't make a right I suppose and also it is illegal. But so should be the tax Grab and lies peddled by the government/treasury trying to justify this as they have . I hope the legal challange works, that Osbourne is made to pay by losing his job, and the same for the other one

I am so pleased we have such an intelligent, articulate and hardworking bunch fighting this unfair tax change. Let's hope we win this fight.

Hi Markb
You are right that it is important to raise awareness amongst students and you have written a very good letter. It would be good if someone can help edit it and it can be sent out. It is quite a challenge, but maybe someone can help sort out a mailing list to get it to student unions and anyone else/anywhere else where students and their representatives will read it. One problem is that it is a 'transient' population and will affect some people who are still in school and have no idea what is going on. Their parents will be impacted though. And as students and young professionals often rent similar kinds of private housing it could affect these young people for years, affect their living standards and damage their prospects of saving for a deposit later on when they want to settle in an area.

Rents will be climbing now. I have increased my student rents for the next year, when they have remained fairly static for years, and coupled with the more expensive institutional lets, it is not a good prospect for students. I think these HMO tenants will bear the brunt as it is easier to increase rents in these areas than in others, in my experience. So, in a way, often they will be subsidising other parts of landlords' portfolios, because of the need to build a war-chest to pay tax on fictitious profit - and in some areas it is more difficult to increase rents. As business people we will obviously increase the rents where we can and by as much as we can in order to survive.

Sorry I can't be of more assistance with this personally at the moment, but I think it is important and hope that others reading this can help you get this off the ground.

Paragon willing to consider switching from individual to company mortgages....

Extract -

Tax changes – have you started planning?

We are aware our landlord customers are considering a number of different approaches to structuring their affairs to be as tax efficient as possible. Because individual circumstances vary significantly for each customer, Paragon cannot recommend any particular approach.

However, on a case-by-case basis, we can consider requests to transfer an existing mortgage in a borrower’s personal name, to that of a limited company set up by the borrower to hold the property.

Unfortunately Paragon will only lend to companies as the sole debt provider and offer no special incentives other than the published company rates.

I sent emails to a great many university accommodation depts and also the student union back in July or August last year. I didn't get a reply from any. Hopefully now that they are beginning to understand the problem we may be able to get them on side. I haven t got a list of them, but I think I just googled 'universities in the U.K.' . I did have to click through to each to get the email address.
