The first part of 5.16 refers to a real loss as calculated under the current rules. C24 may turn this into a profit on which tax will be due.

The second sentence summarises the current rule on losses. It is assumed that this rule will continue. However, it would be unusual for a loss to arise under C24 – it would mean that the other, non-finance, costs exceeded the rent received. In this case no tax would be payable, and as there is no profit, no interest relief would be given either. The finance costs would also be carried forward.

"Straw poll of around 200 professionals at the Build to Rent conference today hosted by the British Property Federation....
1 - The affordability crisis is caused by a crisis in housing supply? 100% in agreement.
2 - Will we ever build 50,000 new homes a year? Not a single hand is raised.
So the Build to Rent industry is unanimous in telling us we won't build enough homes and the government is intent on pushing out smaller private landlords from the sector.
How can anyone in their right mind think this is going to have a happy ending???"

Very positive article but as much as I would love to offer longer term tenancies I won't be until the ability to get vacant possession can be measured in weeks rather than month's.

I see on the PIMS site this morning that Belvoir Lettings are warning about the effects of clause 24 and asking their Landlords to contribute to the Judicial Review fighting fund.

Why are the RLA and NLA not urging their members to do this? I'm in the RLA and will NOT be renewing my subscription. I think they have been useless.

The Managing Director of the letting agent’s franchise, Dorian Gonsalves, said: “The campaign for a judicial review of Clause 24 of the Finance Act 2015 was launched by two hard working Buy to Let landlords who are trying to prevent what is believed to be discrimination by the government against individuals who borrow money in their own names in order to fund their portfolios,

“The campaign is something that the company fully supports. Over £50,000 has now been pledged by landlords, agents and other affected sectors of the market. Belvoir's franchise owners will also be writing to landlords and inviting them to pledge their support for this important legal challenge” says Gonsalves.

"Unfortunately, the chancellor’s recent tax attacks on landlords are doing nothing to encourage more supply. The news that the 3 per cent levy being added to Stamp Duty for the purchase of buy-to-let properties will not be levied when 15 or more are bought at once only encourages foreign bulk-buying of London’s new developments."

HI Stewart, I share your sentiments and have put them to the NLA numerous times. If you haven't done so please have a look at yesterday's chat on the Judicial Review thread. Steve Bolton offers some hope that maybe, just maybe, there is something going on behind the scenes with NLA, the RLA and others. I certainly hope so. In these desperate times all resources should be pooled whatever the other trivial differences might be.
