Hi Ed, yes looks interesting. I still feel it is far too early to do anything. We do have a number of years before it is fully implemented, and I'm sure that if clause 24 is passed in parliament then some very clever tax accountants and barristers will come up with something to mitigate it. But again, for me personally I wouldn't like to be the test case in the court with HMRC - I will watch and wait.

In the mean time, lets hope the treasury committee see sense!

JMcD obviously thinks that repairs are like MPs expenses - you can claim what you like and never have to prove the expenditure actually occurred.

Anyone have any idea of the time scales for the act to likely reach its final draft. Getting to the point where I can't waste too much effort till the whole scheme has been agreed by parliament.

Still, my local MP has left a bad taste in my mouth with his total disregard for other peoples time.

i spent a little bit of time yesterday looking into it and the accounting forums suggest there was a change in 2013 regarding partnerships between ltds and people to remove the possibility of using that type of structure to reduce tax

however that is a simple internet search a more detailed look into the matter is probably warranted. If anyone wants to discuss it with their accountants and get their views that would be helpful

one thing the accounting forum said was that this shouldn't be done to reduce tax. however if you are going to go into a situation of negative cashflow then perhaps it would be logical to save it was to save yourself from negative cashflow rather than tax?

again im no accountant or expert on gov tax laws however there may be some merit on partnerships being able to use interest as a cost

this might be in the form of two human partners (eg husband and wife) or in the forum of one human and one LTD. The partnership has to file a self assessment return so its a question in my mind how the partnership assessments work as its a bit like a company structure especially when its a partnership with a LTD

also the accounting forums I read suggested the LLP model is getting far to complex and that some people are asking the gov to just tax the partnership (probably at the going corp rate) to make things simpler

I would ask one of the bigger landlords with large numbers of properties to have a discussion with a professional and see what they say. If someone could get an estimate of the costs of this sort of advise or service maybe we could have a collection whereby a large number of us contribute a small sum towards it than one landlord take it onto themselves as a cost

I still think it is far too early to look for creative solutions, and I would be very cautious about spending a lot of money to alter the structure of the portfolio to find that the treasury close off the tax advantage in the next budget.

I'm sure many accountants and tax advisors are working on this as we speak, as they can up-sell the solution to clients in the future - but until there has been a test case and HMRC approval I would tread carefully.

I am still slightly optimistic that the proposal will be amended - if not now, then in a few years time when rents get out of control due to lack of new supply and an ever increasing population.

Also, I'm now coming to terms with the fact that we will always be the villains whether we like it or not, and we are going to have to get used to it. No MP's are going to stick up for private landlords because it would be career suicide for them. We are an easy target and things are only going to get more difficult. However, the rental market is not going to disappear and there will be some amazing opportunities that come out of this.
