Playing devils advocate.....the tax man will say.....The flaw in what you propose is that it's easy for anyone to avoid becoming a higher rate tax payer by taking on more debt. .....exactly the behaviour they are trying to stop.

I am formulating a question for a FoI Request. Does anyone know if it is better to ask one or two simple questions or one longer one?

e.g. How many rented properties in the UK by region are let by sole traders v limited companies?

By asking 'by region' does this over complicate the request? Should I ask a different question for each separate region?

If we are only supposed to put in a limited number of requests before we become 'a nuisance' I want to ask the right question.

Any other ideas for questions?

I'm a bit worried about the RLA putting together 'alternative tax proposals.' We need to have an idea about what they are thinking. Neither they nor we speak for all landlords. The abolition of our logical right to offset all of the costs of our business shouldn't be open for discussion. The 'alternative' must then be something different. Any constructive ideas regarding what could be fair?
Personally, I think it's the wrong question. It's like saying: 'we're going to attack landlords and as you're a landlord, can you tell us the best way for us to attack you and get away with it?'

Gentlemen

I am concerned about the very dangerous tax precedent created in the Summer Budget 2015 in respect of the restriction of finance cost relief to individual landlords.

If clause 24 of the Finance Bill receives Royal Assent without amendment, what is to stop Government applying the same restrictions on finance cost relief to all small businesses trading as partnerships or sole traders?

The proposals affect businesses with a high reliance on interest bearing debt. An example of how landlords will be affected can be viewed via the linked articles below

2) What is Aunt Sally going to do now?

I am invited to consult with The Treasury about the proposed clause 24 of The Finance Bill on 24th August 2015.

I represent landlords, of which over 120,000 are following an online discussion on which circa 2,500 comments have been posted – link.

I look forward to hearing from you with a view to discussing how this dangerous precedent poses a substantial risk to small businesses.

Revenue, losses cannot be offset against against Capital. A well established taxation principal.

However, as the chancellor had already thrown out the established taxation principal i.e. not allowing cost. Why not this one ? Don't hold your breath as this will work against the zest to collect as ,much tax as possible.

Further to our discussion here yesterday regarding F.o.I requests please confirm that you have submitted the questions you raised on this forum as F.o.I requests.

If you don't submit them, somebody needs to do so. The answers to these questions may be very important.
