Hi, available on BBC iPlayer is the programme ‘Morning Live’ from 12th July 2024, where Matt Allwright advises tenants to remain in their homes until the bailiffs arrive, rather than risk becoming intentionally homeless

He also says that the Department of Levelling Up has told him that the government will abolish Section 21 but have not confirmed a date or any detail.

Thoughts of this forum? Given this is the same advice councils have been peddling against ministerial guidance surely some complaints need to be raised.

Only plus was he said rent should be paid but gave no caution to tenants that they could become liable for costs.

When a Section 21 Notice is received a tenant should…

1. Speak with their landlord. If the reason is selling, maybe the tenant would like to buy the property.

2. Look for somewhere else to rent.

3. Contact the Council’s homelessness team.

4. Register for Social Housing (if they haven’t already).

4. Move out voluntarily only when they have somewhere suitable to live. This could lead to additional costs.

As a ‘landlord’, it’s frustrating but what would you advise your son or daughter to do?

I say ‘landlord’ because if you are selling, you are more of a property investor than a landlord.

Totally, London Landlords get this and go through the motions making sure they apply on time at every stage. If, you do not then it can take over a year.
There is an illusion of no housing in London whilst it is being built all around for over seas investment. This is where the "landlords" should direct their ire. Not the homeless departments that are caught in the irony.
That and the creation of a dependent and childlike population.

The issue is that if someone has deemed to have made themselves homeless (by voluntarily moving out), there’s no duty on the local council to house them. This is why the advice is given.

What needs to change is the guidance councils use to determine cause of homelessness.

Its not the guidance. it is legislation and of course if at any point the landlord pulls back there side of legislation. There is no risk of homelessness. Why would a high demand council place people in temporary accommodation if there was no longer risk of legal homelessness. Then, they would be taking anyone that said they would be homeless.

Landlords need to come and sit on a customer services desk in a housing department. We see it from your perspective and therefore work with clients from the valid notices . But, if there is no alternative housing. As fellow poster said. Where do they go???

Tell them to pay their rent and/or cease ASB.
The two main reasons for landlords serving section 21's.

Why is it always down to an individual with a business to ensure people are housed?
If we cannot get a reasonable return on our investment we will be forced to sell.
I say that as a landlord who has on several occasions accepted " the car failed it's mot, can I pay half this month and make it up next month " from my tenant's.
Most landlords are good people but you will miss us when we are gone.
In essence, stop spouting the same old communist rhetoric and fix it with your money not mine!

All be sorted soon - labour are in power- section 21 already abolished from day one- as Angie promised all those tenant voters in favour - ☹️. We have nothing to fear - just sit back will and labour sort it out. 🤣🤣

All well and good if expecting to rehoused by the Local Authority but disastrous if wanting a private landlord, and the repercussions of having a (another) CCJ added to your name is never told to the tenants doing this.

With rental properties continuing to be sold out of the PRS market such advice is bonkers and detrimental, and just getting on the "let's knock private landlords" syndrome.
