The story of the Bank of Ireland decision to increase to the differential (interest rate margin) on  tracker mortgages started on this forum when a professional landlord contacted Property118 within minutes of a letter from Bank of Ireland landing on his door mat. What ensued was outrage from landlords and affected residential mortgage borrowers. The story was quickly picked up by the National Media as it wasn’t just the 13,500 affected borrowers who were worried.

Will this set a precedent for other mortgage lenders to follow?

Property118 reacted by using funds donated to The GOOD Landlords Campaign to underwrite the cost of a barristers opinion on the legality of the Bank of Ireland’s actions. Of the 13,500 affected borrowers, 1,200 have had the decision reversed by Bank of Ireland. With additional support and pressure we believe all affected borrowers can and will see justice done.

Lee, a professional Landlord asks, “help! I have just received a letter from the Bank of Ireland stating they want to increase the differential on my tracker rates.

I have 12 mortgages with the Bank of Ireland previously Bristol and West. I have been on a base rate tracker of 1.75% above base, but now Bank of Ireland are using some fine print claiming they have to recapitalise and saying the ‘new differential will be 4.49%.

How can I fight back?”

The original policy wording seems to be:

6 INTEREST

Charging interest at a tracker rate

(j) Unless we change the differential (if any) under condition 6 (n), we will not change the tracker rate unless the base rate changes.

(m) in condition 6 (n):
– a “positive differential” means a percentage which we add to the base rate to arrive at the tracker rate; and a “negative differential” means a percentage which we subtract from the base rate to arrive at the tracker rate.

(n) We may reduce a positive differential or increase a negative differential at our discretion by giving you not less than seven days written notice. This means that we can change the differential in a way that is favourable to you.

The above seems to indicate that they can reduce the rate in my favour, but not give them the right to increase it. Am I correct?

There is always going to be a difficulty with this. What is the reason for a private forum? Is it that it needs to be kept secure to prevent BOI "spies" getting advance notice of what we are doing? Yes they will be doing this and good morning to those BOI staff monitoring this forum.

Is it that those who have paid want to keep the information and advice they have paid for in the knowledge of those who have paid for it? Probably.

Is it that there are issues legally for the law firms involved in this to keep tactical information on how this should proceed confidential? Again probably yes. They would need to be the gatekeepers as to whom accesses any private forum.

So on balance a private forum for several reasons would be a good idea and probably necessary.

Gary - Agreed. If we end up with 1000 paid members, How else will we all communicate in private with the legal eagles without a private forum. Good job on setting it up. Seems fine to me. lets get approval off Justin before moving forward.

Also I & think everyone on this forum should remain on it as the first source of open information. I certainly am & am grateful to have stumbled across the site.

Ian - I was just thinking about that. Thats why i think its best to have Justin see on the next way forward. Maybe confirm true account holder etc. I'll leave it up to them to decide.

I put 99% effort into what i do on the last 1% i then decide weather to carry on or to give up if i decide to give up give up i go down the pub for a pint & for get about it. Ive put 1% effort into this & 99% is being done for me. let the experts do there job & chill out. Im now of to my AA meeting i used the 1% to often.

If it's decided that there is a case against the BOI and the matter proceeds to litigation or negotiation then surely the more people that know this the better. They can then make a proper judgement on whether to contribute financially , with the likely hood of far more than the initial £ 120 being required , To keep counsels advice and any ongoing plans a secret does not encourage more people to join. The complete opposite in fact.
