Hi all, I have unfortunately found myself in the position where I need to sell the house that I rent out to a young family. I served them with a section 21 notice 6 weeks ago and as expected they are finding it very difficult to find anywhere else. Only one partner working and also the fact that local rental values are significantly higher than what they’ve been paying with me.

They have been to the council and as usual, they have been told that they cannot help them unless they are homeless so I guess my tenants have no choice but to sit it out and wait for me to take it further. May I add, that they have no rent arrears at this stage and have always paid on time each month.

My question is having never done this before, is it straightforward to apply to the courts myself? I have the forms ready to send if they haven’t vacated by the end of the month.

All the relevant paperwork was given at the start of the tenancy and I have signed proof from them that they have received everything.

Any advice would be gratefully received.

If you haven't done it before then use an eviction specialist like Landlord Action or similar. Even experienced landlords and letting agents outsource eviction matters.

The legislative and legal pitfalls at all stages of the process mean it's easy to fall foul and end up at the
" bottom of the snake" in the snake and ladders eviction " game" and have to start again.

What the council don't tell the tenants is that staying put awaiting bailiffs is a) It's against Department of Levelling Up Guidance, and b) They end up paying the court costs for a possession order.

You could always try persuading them to move. You could offer to give them, as a lump sum, the difference in rent per month for the next 12 months if they move out. I know this pushes the problem to the next landlord but at least the young family will have somewhere decent to live for the next 12 months.

£1200ish specialist eviction company. £4000ish solicitors, not necessarily their specialist field.

For a Section 21
You now have to show you had a gas safety certificate before the tenancy started & have one for every subsequent year.
This rule came in around 2017 from the court
Caught me out recently.
If you can, use a company which specialises in evictions

Definitely use an eviction specialist. Saves you having to make contact and they make sure they get it right. I used Landlord Legal Group after trying to evict myself. Much cheaper than a solicitor

Hi Ashleigh - Section 21 is predominantly a paperwork exercise so you need to have absolute confidence in your record-keeping and legislative compliance to ensure you gain possession. It's a lengthy process and I see lots of confident Landlord's who still get it wrong, costing them more time and money in the long run.
