Have I been scammed into Leasehold?

Have I been scammed into Leasehold?

I have just purchased a house from an auction and the legal pack said the house was Freehold, even Land Registry right now says the house is Freehold

However, only one day before the auction, the auctioneers put a document in the legal pack saying it has a 999 years Leasehold.

How can I solve this issue?

What are my rights at Auction, and have I been scammed?

Thank you for any assistance

Andrew

When were you aware of this apparent change of status? If the LR say the property is freehold, could it be a simple mistake? If not a mistake, ask your solicitor to sort it out!

Ah you have indeed been caught out as so many buyers have been, where they only find out near the end of a purchase that their freehold house is actually not free of hold. Usually they have already spent thousands on fees & surveys, and this is just one of many reasons why the NLC is petitioning for so much that needs change - abolishment of this 1066 feudal system, correct & full information to be provided much earlier in the buying chain etc
The whole tenure is a minefield of unfairness & inaccuracies.

Pardon my ignorance, but if the property is showing as Freehold on the land registry at time of sale isn't that legally binding?

Reply to the comment left by Gracie at 09/07/2021 - 11:05thank you for the reply, yes indeed it was changed 1 day before the auction and in the same legal documents it still says that is is a freehold.
But on the same legal pack, under the name of auction contract there is a leasehold subject for 999 years lease and this leads to a 1.000 ground payment anually and other bits and pieces.
when the solicitor sent me the legal packs with the added leasehold, i did not sign the paperworks. The house still is not on my name, but i had fully paid the house beforehand.
it has been about 30 days that i have fully paid the amount, but still trying to find a sollution to backout because of the missleading information they gave untill the auction day.
I would really appreciate any type of idea, it cant be that easy to get all the hard work that has been done to buy a house.

Reply to the comment left by Tim Rogers at 09/07/2021 - 11:42would love to sent the lagal packs and the adrees to yourside
i think auctions buy a freehold house, which was a freehold from the beggining
and that put a contract in it to change it as a lease for the buyer

I am not sure if i can post the link of the legal pack but if you check it, the last 2 documents were added the day before the auction, the dates can be seen.

Also the first document is the proof that it was stated as a freehold till the auction.

A house that BECOMES leashold?
I'm under the impression that that's illegal nowadays because of abuses such as excessive service charges and/or g/rent doubling frequently.
But this "bait and switch" is illegal - like if I sell you a cooker, and then, the day before "delivery", I notify you that it is just a photo that you have bought!
Probably NOT the direct fault of the auction house, and I hope that auctioneers as described by "andrew samuel" are very scarce!
The expression "fraud by misrepresentation" comes to mind ...

£1k ground rent holy cow, That's why it's at auction. It's not mortgageable, banks are learning to stay away from those. How often & by what measure does it increase? What area is the house in? Luckily for you ground rents are the first thing that the gov has looked at making fairer, you may only have to wait a few years.

Funny how often auction properties suddenly have details added last minute, it's a known risk that you have to keep checking isn't it. Perhaps something that the law needs to clamp down on. Packs must be sent, & any additions after being sent must be specifically notified to anyone who received the "old" version. I can understand innocently getting additional info late, but that's very convenient to always be the case - it's a smelly practice..
