In a recent letter to all MP’s, landlords have pointed out the potential unintended consequences of a proposed change to the law intended to ‘enhance the rights of those who rent‘.

Section 258 3(c) states
For the purposes of subsection (2)(a) a person is a member of the same family as
another person if—
(c) one of them is, or is a relative of, one member of a couple and the other is a
relative of the other member of the couple.

We wrote to all the MP's and also senior civil servants pointing out that abolition of the S21 could have serious repercussions, especially increasing homelessness.
Unfortunately, we are seeing this now happening.
I agree with Jon Mac that not enough landlords belong to a Landlord Association. By having a healthy membership, they are more likely to be listened to.
And by the way, many of the existing Landlord Associations across the country liaise on a regular basis.... Read More
Note that it is intended that MEES will probably apply to owner occupiers as well, eventually. In that a property with a low EPC rating can't be offered for sale without a valid exemption.
And as it affects landlords, mortgage companies will probably not be allowed to arrange a mortgage.

You will see in our letter that we are calling for joined up thinking, in that we want the mechanism for EPC's to be sorted out before MEES.
Additionally, we have published a separate report for DLUHS calling on the Ministry for ‘a ‘root and branch’ review of the current system, rather than the ‘tinkering at the edges’ of this highly regulated sector, poorly served by an overstretched, legal system.’

We hear everything said, and can understand the immediate reaction.
We totally agree that landlords won’t be evicting for no reason, and we make that point quite strongly in our paper. The intention of the Government is to abolish section 21 evictions unless a landlord wishes to sell their property. The intention, therefore, is to create "Life Tenancies."
Our proposal seeks two things. First, to retain section 21 evictions.
Second, in the event a landlord chooses to use a section 21 eviction (a no-fault eviction) to make the process fairer by covering the tenant's costs, and allowing a longer period of notice.
There is nothing in our proposal that will stop a landlord using a section 8 notice. There is nothing in our proposal compelling a landlord to use the proposed modified section 21 eviction process.
In short, we firmly believe section 21 evictions should be retained. We respectfully, suggest you read our detailed paper, which appears on our website under "Campaigns"
