Find out which rooms the damp is in and if it is on outside walls.... it could be a failure of water goods - fairly cheap to repair. Don't let the agent fob you off... insist on you personally going to do an internal inspection - with or without them... Read More
I had an agent try this on me a few years back when i asked for the result of the credit checks, copies of pay slips, references etc when they were trying to find me a new tenant.
I spoke to the Data Commissioners office and they agreed that a landlord is a "material party" to the contract (AST) and is fully entitled to all information in order for us to make an informed decision about the efficacy of signing an AST with the applicant.
When i had a tenant who was actively breaking the law, if memory serves me the S8 clause that I could have used said something about needing a conviction before applying for a court order to get possession.
If there are a number of S8 clause applicable a judge might accept a non-conviction if it is part of a "body of evidence"... Read More
thanks mandy - yes this is a legal dogs dinner. The CT is still in the brothers name. He last paid some pittance of rent in December. I doubt she could pay off the arrears - she is a part time care worker and student. Looking at it from her perspective - why should she pay off her brother's debt? She could spend less money and get a new home - if she could find one.
You are right about the sub-tenancy business... it complicates things....
I am tempted to submit for repossession on line then change the locks once its granted and give her the tenancy if her credit checks/income come back ok.... Read More
